People´s Deputy of Ukraine V. Shemchuk, author
of the bill
(Reg. No.7113) suggested
enlarging
the register of circumstances mitigating and aggravating a punishment. The
bill states
that commitment of violent acts to protect a family
member or other close
relative mitigates the punishment, whereas the violent
acts against a family member or
other close relative aggravates a punishment.
V. Shemchuk stated that analysis of the investigative and judicial practice proved that violent acts were often committed to protect a family member or other close relative from the criminal offense, while the judges often neglect this circumstance.
The Committee members upheld the bill, since its adoption will improve the criminal and judicial legislation as to the criteria of assessing the social danger of the committed acts of violence.
