The first bill on amendments to the clause 39 of the Law "On Telecommunications" (regarding fundamental principles of the national security in the sphere of telecommunications) (reg. No7023arding ) obliges the telecommunication services operators and providers using their equipment for the rendering of telecommunication services, at own expense, purchase and install in the order defined by the Cabinet of Ministers of Ukraine, in the telecommunication networks, specialized equipment for the operations-investigatory measures, performed by the authorized bodies.
An alternative bill (Reg. No7023-1) on amendments to the clause 39 of the Law "On Telecommunications" (regarding installing on telecommunication networks of specialized equipment for wiretapping and its payment by the authorized bodies) obliges the telecommunication services operators and providers using their equipment for the rendering of telecommunication services, after the court decree and in order defined by law, purchase and install in the order defined by the Cabinet of Ministers of Ukraine, in the telecommunication networks, specialized equipment for the operations-investigatory measures, performed by the authorized bodies. The rate and order of the payment for operators and telecommunication services providers funds for lease of their equipment and premises for the placement of equipment of authorized bodies and compensation payment for the expense on placement, maintenance and protection of these technical means are established by the Cabinet of Ministers.
The Committee members defined that the bills are not coordinated with the legislation of Ukraine and their adoption would lead to the violation of economic entities rights and principles of the economic activity condition established by the Economic Code of Ukraine and would facilitate increase of the tariffs for the telecommunication services.
In the result of the discussion the People´s Deputies deem it necessary to forward the bill to the authors for elaboration taking into the consideration propositions and amendments of the Cabinet of Ministers, Central Scientific-Expert Office of the Verkhovna Rada of Ukraine Secretariate, executive power bodies and introduce for the parliamentary scrutiny the coordinated bill that would unite all the constructive principles of both bills and effective Law "On Telecommunications" for the stable development of telecommunications in Ukraine.
