The bill (Reg. No.5370) supplements the Code on Administrative Legal Proceedings of Ukraine with a new clause 181-1, amends clause 3 of the Law "On Court Enforcement Action" and 34 other Laws of Ukraine to regulate imposing of penalties on the legal entities and other legal bodies for the infringement upon legislation norms.
The Committee members emphasised that the suggested norms on the special order of legal proceedings on the category of cases mentioned (new clause 181-1 of the Code on Administrative Legal Proceedings of Ukraine) are legally incorrect. They are not harmonized with the principles and other norms of the effective Code on Administrative Legal Proceedings of Ukraine, contradict certain norms of the Civil Code of Ukraine, while their separate principles restrict the content and scope of the existing rights and freedoms of the citizen, thus contradicting clause 22 of the Constitution of Ukraine.
Hence, the Committee resolved to recommend the Parliament to forward the bill for adjustment.
