The Committee on Legislative Support of Law Enforcement held the Hearings to discuss Improvement and Unification of the Terminology of the Criminal Code of Ukraine

People´s Deputies, representatives of the General Prosecution, Ministries, departments, education and research establishments and institutions attended the hearings.    

 

Volodymyr Oliinyk, First Deputy Chairman of the Committee, opened the hearings. He declared: "Effective implementation of the Law largely depends on the precision of its provisions and definitions, accuracy of concepts and terms. It is especially true for the application of codes such as the Criminal Code, which are fundamental for legal regulation of different branches."  

 

V. Oliinyk mentioned the lack of a unified approach of the legislator to the definitions in the Criminal Code.

 

V. Oliinyk suggested that the attendants of the hearings discussed whether the Criminal Code could be supplemented with a ‘terminological´ chapter, the issues of defining the criminal-legal concepts in the Resolutions of the Plenum of the Supreme Court, and the restrictions for loans from the resolutions of the European Court of Human Rights into the criminal law.     

The participants of the hearings suggested new methods for defining the concepts in the articles of the Special Part of the Criminal Code.

 

As one of the possible options of inserting the ‘terminological chapter´, the speakers suggested separating criminal-legal terms into a special article of Chapter 1 "Common Provisions of the General Part of the Criminal Code of Ukraine."

 

The participants of the hearings called for investigating the improvement of terminology of the Ukrainian criminal legislation. They suggested setting up a working group in charge of improvement and unification of the terminology of the Criminal Code of Ukraine.
