The bill (Reg. No6308) suggests improvement of the criminal-legal norm regarding the liability for the forgery of a document, seal, stamps and printed forms etc and eliminate gaps in the criminal legislation. Relevant amendments are to be introduced to the clauses 357, 358, 366 of the Criminal Code, in particular, the legislative definition of the term "official document" is to be done.
V. Shemchuk, the bill´s author declared: disposition of the clause 358 of CC of Ukraine is overburdened by the unnecessary particularization of the subject that makes the text to complicated for the comprehension. Even more complicated, according to him, is the text of the new version of the clause, putting of which into force is planned on 1 January 2011.
The author stated: analysis of the judicial practice shows that the actions of the officials that made service forgery is partially qualified by the part 2 clause 358 CC of Ukraine that, if taking into the consideration the text of this part, is inadmissible as part 2 clause 358 envisages the liability for the repeated or after the preliminary plot of the group of persons commitment of the actions, enumerated in part 1 clause 358 and no clause 366 (service forgery).
The Committee members upheld the bill as its adoption facilitates the unification of the implementation of the indicated criminal-legal norms in practice.
