Judicial System of the State is supposed to protect People, first of all, Their Rights and Liberties, V. Lytvyn

Volodymyr Lytvyn, Chairman of the Verkhovna Rada, is convinced that it is necessary to simplify the judicial system of the state, that is supposed to execute not punitive function but first of all it is supposed to protect people, their rights and liberties. It was declared by the Head of the Parliament on Thursday in the course of the pres conference in the Parliament, giving answers to questions regarding the Law on Judicial System that was adopted in the Parliament recently.

 

V. Lytvyn stated that he "thoroughly investigated the bill on judicial system that concerned the part regarding the authorities of the Verkhovna Rada of Ukraine." The Final Provisions provide the whole chapter on amendments to the Law on Standing Orders of the Verkhovna Rada of Ukraine that according to the Head of the Parliament is absolutely inadmissible. "I have been doing everything possible for this Law corresponds the Law on the Committee of the Verkhovna Rada of Ukraine and on Status of the People´s Deputy of Ukraine", he announced.

 

The Head of the Parliament declared that he had dual attitude towards the novations that are suggested by the Law. According to V. Lytvyn, the specialists are convinced that now there would be better opportunities for the implementation of the positions regarding the protection of human rights and liberties, approaching of the judicial system to the citizens. "Though, the principal drawbacks of it is that the quantity of the Supreme Court of Ukraine members is reduced and its functions are altered", V. Lytvyn indicated and added that "it is the issues for the main discussion plus one more issue regarding the broadening of the authorities of the Supreme Council on Justice."

 

Chairman of the Verkhovna Rada of Ukraine does not agree "to the fact that the President of Ukraine, according to the Constitution, being the Guarantee of Rights and Liberties of the Citizens is totally deposed of the judicial branch of power." V. Lytvyn reminded that the President of Ukraine used to enter the personnel of the Supreme Court of Justice "he was aware of all the problems regarding the evaluation of the judge work and their responsibility for the offices they occupy etc."

 

Though, when the mentioned above decision was adopted and "declared as the positive one that the President terminates a part of his authorities and that the decision is to be adopted", the Head of the Parliament "has no reasons to object." "Still, I am convinced that the power is unitary, but there are different functions, authorities and branches", V. Lytvyn emphasised.

 

He reminded that the mentioned above Law was directed to the Venice Commission and its experts recommended not hasten its adoption. Though, they indicated on the broad authorities of the Verkhovna Rada of Ukraine and these positions were excused form the Law, V. Lytvyn declared and added that the discussion of this matter is still continued.
