Mykola Tomenko: A New Composition of the Government shall be expected after the Constitutional Court and the Verkhovna Rada pass the Resolution on the Constitution

 

Mykola Tomenko, Deputy Chairman of the Verkhovna Rada of Ukraine, believes that a new composition of the government will appear after the completion of the Constitutional reform. "The changes in the Government´s composition may appear soon, however, drastic changes may be expected after amendments to the Constitution of Ukraine are introduced", he stated.

 

M. Tomenko emphasised that if the Constitution adopted on 28 June 1996 is restored (after the judgment of the Constitutional Court and the decision of the Verkhovna Rada), the outcome will be as follows: first of all, the situation, when the Government is formed by the President instead of the Parliament. Moreover, the Verkhovna Rada will be only authorized to give consent to the appointment of the Prime Minister of Ukraine by the President of Ukraine (clause 85, item 12 of the Constitution of 28 June 1996).

 

The second outcome is clause 114 of the Constitution of 28 June 1996 that defines the personnel of the Cabinet of Ministers as the Prime Minster of Ukraine, the First Deputy Prime Minister, three Deputy Prime Ministers, and Ministers.

 

"Thus, if the model of the presidential-parliamentary republic is restored, the President shall appoint the Government. Moreover, the Government can include only one First Deputy Prime Minister and three Deputy Prime Ministers. Nevertheless, today, one First Deputy Prime Minister and five Deputy Prime Ministers are in office", the Deputy Chairman explained.
