The Committee on Legislative Support of Law Enforcement recommends that The Verkhovna Rada rejects the Bill on Amendments to the Criminal and the Criminal Procedural Codes of Ukraine regarding Establishment of the Criminal Responsibility for Calumny

The bill (Reg. No.6398) submitted by People´s Deputy of Ukraine Kiseliov V. O. supplements the Criminal Code with the new clause 151-1, that envisages the criminal liability for calumny, and supplements the Criminal-Procedural Code regarding the investigative jurisdiction of crime cases envisaged by the new clause of the Criminal Code of Ukraine that are aimed at the establishment of stricter liability for the conscious fictitious calumny.

 

Having analyzed the bill, the Committee members agreed with the conclusion of the Central Scientific-Expert Department, pursuant to which "non-property (private) rights to which belong honour, dignity, reputation belong to the subject of civil law regulation that provide sufficient protection in case of the calumny. "

 

The Committee members also pointed out that criminalization that is establishment of the criminal liability for certain actions can not be done arbitrarily, based on the subjective propositions, demands or wishes.

 

According to the Committee members, criminalization of the activities explained in the bill needs thorough argumentation.
