The Committee on Environmental Policy, Use of Natural Resources and Elimination of Consequences of Chornobyl Disaster recommends that the Parliament forwards the Bill on Amendments to the Law "On the Status and Social Security of Victims of Chornobyl Disaster" (re Pension Provision) for further Drafting

The bill (Reg. No.4321) suggests a new version of clause 54 of the effective Law regarding calculation of the disablement pension as a result of severe injury or illness connected with the consequences of the Chornobyl disaster and a loss-of-breadwinner pension caused by the Chornobyl disaster. In particular: calculation of the indicated pension according to the formula envisaged by the Law "On Compulsory State Pension Insurance"; introduction of amendments to part three of clause 59 regarding calculation of the disablement pension to the persons that took part in the liquidation of the consequences of the Chornobyl disaster in the course of the service under the condition the indicated individual express their will to receive pension not from the fivefold rate of the minimal wages that was implemented during that period of service in exclusion zone, as it is envisaged by the legislation, but from tenfold rate of the indicated minimal wages .

 

Legislative proposition, according to the People´s Deputies, needs special attention. However, the suggested way of regulation of these issues arose a number of remarks.

 

According to the Committee members, provisions of the suggested new version of part one of clause 54 of the Law "On Status and Social Protection of the Citizens injured in the result of the Chornobyl Disaster" need further harmonization.

 

Proposition in the part 2 of the Final Provisions of the bill regarding the order of calculating or nominating the pensions according to the conclusion of the Central Scientific Experts Office of the Verkhovna Rada of Ukraine Secretariate is groundless.
