Necessity of Implementation of Minimal Wages Principle in the course of Calculation of Basic Accounting Unit of Penalty Rate was discussed during the "Round Table" Discussion in the Committee on Legislative Support of Law Enforcement.
In the meeting took part the People´s Deputies of Ukraine, representatives of the law enforcement agencies and scientists.
Volodymyr Moisyk, the Chairman of the Subcommittee opening the discussion emphasised the necessity of the problem under investigation as tax free minimum of the citizens´ income at the rate UAH 17 that is used now for the calculation of the penalty rates is not suitable for the present economic and social situation.
"Legislators trying to solve this issue suggested several divergent variants. One of them was suggested by the People´s Deputies A. Senchenko and S. Velizhanskii. They submitted for the parliamentary scrutiny two bills "On Amendments to the Code of Ukraine on Administrative Infringements regarding the calculation of the Penalty Rate" (Reg. No.4107) and "On Amendments to the Criminal Code of Ukraine regarding the defining of the Penalty Rates" (Reg. No4134)", V. Moisyk stated.
The Chairman of the Subcommittee informed also on the approach suggested in the bill by the People´s Deputy of Ukraine Yu. Propkopchiuk.
Chairman of the Subcommittee briefed on other approaches in this problem solution. Certain scientists also pointed out the attention to the experience of the foreign countries according to which the penalty rate is defined depending on the total annual income of a law infringer or a criminal.
Andrii Senchenko, the People´s Deputy declared that impulse for the elaboration of the indicated two bills was the necessity to liquidate disbalance existing in the Criminal Code and Code on Administrative Infringements regarding the implementation minimal wages principle in the course of the calculation of basic accounting unit in penalty rate.
A. Senchenko also deems the most efficient principle for the formation of the administrative penalties minimal wage principles under the existing social-economic conditions
The participants of the meeting agreed to the fact that there are certain disproportions in the Codes that are to be regulated and expressed for the reasonable approach to the problem solution with the formation of the working group in the Committee for the detailed investigation and elaboration of the situation.
