The Verkhovna Rada of Ukraine adopted the Law "On Amendments to certain Legislative Acts of Ukraine regarding the Prevention and Counteraction to Legalization (Laundering) of illegally obtained Income and Terrorism Financing" in the New Version

The bill extends the list of subjects of primary financial monitoring with notaries public, attorneys, subjects of entrepreneurship that render legal services, real estates traders (realtors), mail service operators (in the part of money transfer), traders of precious metals and jewels, auditors, auditing companies, legal entitles that hold any lottery, subjects of entrepreneurship that render accounting services, and some other representatives of non-financial occupations. The Bill also supplements the list of public bodies authorized to supervise the subjects listed above the ministry of justice, finance, economy, transport and connections.

 

 The bill was elaborated in order to secure realization of regulations of a new version of Forty Guidelines of the Group in charge of development of Financial Actions on Money Laundering Prevention (FATF), adopted at Berlin meeting of the Group in June 2003, the Council of Europe Convention on laundering, search, attachment and confiscation of fraudulent gains, and terrorism funding, and also the Guideline of the European Parliament and the Council 2005/60/EU on prevention of use of financial system with the purpose of money laundering and terrorism funding.

 

Relevant amendments are based not only on the Forty Guidelines of the FATF, but also on the Convention on Laundering, Search, Seizure and Appropriation of Illegally obtained Income that was ratified by The Verkhovna Rada of Ukraine on 17 December 1997.
