Committee on Legislative Support of Law Enforcement recommends that the Verkhovna Rada adopts as a Basis the Bill on Amendments to the Criminal and Criminal Procedural Codes of Ukraine regarding the Harmonization of Separate Norms with the Constitution of Ukraine

The Bill (Reg. No5518), directed by V. Moisyk, the People´s Deputy of Ukraine envisages the amendments to the clauses 44 and 74 of the Criminal Code and clause 6 of the Criminal-Procedural Code of Ukraine expunging from it the principles on possibility to be exempted from the criminal liability due to the clemency appeal.

 

The Committee members indicated that the bill´s adoption facilitate elimination of ambiguities in norms of the effective criminal and criminal-procedural legislation with the Principal Law of Ukraine, liquidation o the present real opportunity of clemency for the guiltless people. The People´s Deputies also emphasised that the adoption of the bill improves legislative regulation of the clemency institute as one of the most important state functions of the President of Ukraine.
