Volodymyr Lytvyn, Chairman of The Verkhovna Rada of Ukraine: The Constitutional Court shall become a Guide for the Entire Judicial System.
Volodymyr Lytvyn on Friday met the Chairman of the Constitutional Court of Ukraine of the Russian Federation Valerii Zorkin.
In the meeting also took part Andrii Stryzhak, the Chairman of the Constitutional Court of Ukraine and judges of the Constitutional Court of the Russian Federation Mykola Bondar and Mykhailo Kleandrov.
The participants of the meeting discussed the peculiarities of the judicial system functioning in Ukraine and Russia, in particular it concerned the work of the Constitutional Court.
V. Lytvyn reminded that according to the Laws of Ukraine, the judgments of the Constitutional Court are not subjects to appeal: "The Constitutional Court renders just judgments."
In the course of the conversation the Chairman of the Verkhovna Rada of Ukraine emphasised the necessity to reform the judicial system, implementing experience of the leading European countries with the effective courts.
The Head of the Ukrainian Parliament is convinced that in case the judicial system is formed in the correct way, "The Constitutional Court that now is overworked shall scrutinize not numerous appeals of the citizens but problems of the resonance character, as now we have contest between Ukrainian and Russian Federation on the quantity of appeals to the European Court."
According to V. Lytvyn, "there is lack of reforms, instead we have fighting for the judicial power for influence on judges, for the formation of the Supreme Council of Justice, for appointing to offices etc." "The issue on the reformation of the judicial system is to be taken away from the politicians", the Chairman of the Verkhovna Rada of Ukraine is convinced.
Asked regarding the system of the legislative activity of the Parliament, Volodymyr Lytvyn expressed for the necessity to order the legislative sphere and alter the election system. He announced that on 28 April of the current year, the presentation of the Election Code draft is planned in the Verkhovna Rada and afterwards the Parliamentary Hearings will be held.
V. Lytvyn deems it necessary to conduct "political structurization on the state level." "We need a program on strategic development of the state. We need a definite vision of the country´s future, afterwards we are supposed to select the instruments for this program implementation", he stated.
V. Lytvyn is convinced that it is necessary to cultivate the political responsibility and set a dialogue between all the political powers. According to V. Lytvyn, at the present moment there is such a dialogue between the Verkhovna Rada, the president and the Cabinet of Ministers. "It is a complicated process though it does exist. Unfortunately there is no dialogue between the coalition and the opposition as we have not mastered the art of compromise. Dialogue and compromise are the real arts."
V. Zorkin emphasised that "the state is a single boat, a single ship and it is necessary not to sink it and these clamps that fix it are the Constitution and the Law." According to him, the situation in the state influences the quantity of the citizens´ appeals to the Constitutional Court: under the stable conditions and normal dialogue between the representatives of the judicial system in Ukraine and Russia and asked the Chairman of the Verkhovna Rada of Ukraine to visit the institution headed by him.
