The People´s Deputy V. Moisyk, author of the Bill (Reg. No 5427) suggests the altering of the clause 222 of the Criminal Code of Ukraine title from "Financial Resources Fraud" to "Illegal Receipt of Financial Resources." The Bill also envisages the supplement of this clause with the new part on criminal liability for "Designedly illegal receipt by the citizen-entrepreneur or the economic participant agents of the subsidies, subventions, grants or credits in the result of the mistake or negligence of the authorized officials that caused considerable property loss." Moreover, the part two of the clause 212 CC is to be supplemented by the words "and also allotment for the individuals, enumerated in the part one of this clause, designedly misleading information aimed at the obtaining of tax subsidies if there are no crime against property indications."
The People´s Deputy deems the overcoming of the negative tendencies in the state credit-finance sphere is possible only under the condition of the action system assistance that are to cover all the spheres of the social life.
The committee members upheld the bill as its adoption, according to them, may improve the legal counteraction mechanism of financial resources fraud.
