The Committee on Justice recommends that the Parliament adopts as a Basis the Bill on Amendments to the Economic Procedural Code of Ukraine regarding the Appeal against the Decision of the Court of Arbitration and Receipt of Writs of Execution

The Bill (Reg. No5322) suggests the amendments to the Economic Procedural Code of Ukraine by a new chapter XVI defining peculiarities of the juridical scrutiny of appellation on the decision of the courts of arbitration and order of the delivery of writs of execution due to the Court of Arbitration.

 

In the course of the sitting, the people´s Deputies emphasized that the Committee have scrutinized and adopted the Parliament adoption as a basis of the Bill "On Amendments to certain Legislative Acts of Ukraine regarding Appeal against the Court of Arbitration and Delivery of Writs of Execution due to the Court of Arbitration."  The Bill (Reg.№4806) envisages the supplement of the Civil Procedural Code of Ukraine with the new Chapter VII-1 "Proceedings regarding the cases on appeal against the court of arbitration judgment and writs of execution due to the court of arbitration to the court of arbitration judgment" according to which should be determined the peculiarities of the juridical scrutiny of appeals against the court of arbitration judgments and writs of Execution due to the Court of Arbitration judgments.

 

The Committee deems it necessary to recommend the Parliament scrutiny of the both Bills at the same time and during the elaboration of the bills for the second reading they are supposed to be united into one Bill.
