The Committee on Legislative Support of Law Enforcement recommends that the Verkhovna Rada of Ukraine adopts in the Second Reading and in its Entirety the Bill on Amendment to the Criminal-Procedural Code of Ukraine (regarding the Right of the Witness for the Lawyer)

The Bill (Reg.№4328) envisages that the witness should be allotted with the right on use of the legal assistance during the procedural actions in criminal legal proceedings with his participants. In particular, the amendments to the Criminal-Procedural Code should be introduced according to which the witness ahs the rights to be interrogated in a presence of the choused by him lawyer or other specialist in law sphere according to the law on legal assistance.

 

The author advanced arguments for the adoption of the Law by the fact that the Criminal-Procedural Code does not envisage the possibility of the legal protection of the witnesses.

 

The Members of the Committee uphold the Bill adoption of which according to them, would provide the opportunity to allot the legal support to the witnesses as a participants of the criminal procedures.
