The Committee on Social Policy and Labour recommends that The Verkhovna Rada rejects the Bill on Amendments and Supplements to certain Legislative Acts of Ukraine (re Use of Labour of Foreigners and Stateless Persons in Ukraine)

The Bill (Reg.№4684 for the replacement) directed by B. Hrubskiy, the People´s Deputy of Ukraine envisages the regulation of the processes of the labour migration and use in Ukraine the foreign labour force. In particular it suggest specification of the categories of foreigners that are allowed to work in Ukraine without the relevant permission for the employment, determining of the peculiarities of the working activity carried out by the foreign citizens during which the visa is not required. Moreover the author suggests strengthening of the responsibility of the employer for the use of the foreign labour force without permission for the employment in Ukraine.

 

The Members of the committee upholding the legislative initiative still declared that the Bill´s principles duplicate the norms that are already presupposed by the Constitution of Ukraine and other normative-legal acts.

 

The Bill also suggests ruling out the participation of the State Employment Service of Ukraine in the procedure of the registration and permissions granting. It is suggested that its functions should be accomplished by the Ministry on Labour and Social Policy.

 

The Committee together with the Ministry on Finance explained that such functions transferring would need extra expenses from the state Budget.

 

As a result of the discussion the Committee recommends that the parliament rejects the Bill.
