The Committee on Human Rights, National Minorities and International Relations recommends that the Parliament forwards the Bill on Amendments to the Law "On Freedom of Movement and Free Choice of Place of Residence in Ukraine" (re Registration of Person's Place of Residence) for further Drafting

The Bill (Reg.№4532-1) envisages the addition of certain number of documents that are to be submitted for the registration of the physical person living place, confirmation the property right on the housing or the owner written agreement.

 

During the discussion the members of the committee expressed certain remarks regarding the bill. In particular it was declared that in certain cases the consent on the on the physical person registration may lead to the violation of this person right on free choice of living in Ukraine (articles 405 and 1238 of the Civil Code of Ukraine).

 

Moreover it was stressed that in certain cases the individuals´ registration is conducted not due to the place of their living. Consequently according to the article 8 of the Law "On the Principles of the Social Protection of Homeless Citizens" the registration is implemented due to the legal address of the specialized institution.
