The Committee on Human Rights, National Minorities and International Relations recommends that the Parliament rejects the Bill on Amendments and Supplements to the Law "On The Verkhovna Rada of Ukraine Ombudsman" (re Mandatory Resolutions of the Ombudsman concerning Prevention of Violation of Human Rights and Liberties)

During the meeting of the Committee it was declared that the Bill (reg.№2569) is aimed at the defining of ombudsman actions and authorities that he must conduct according to the results of the citizen appeals scrutiny. It was also stressed that the bill envisages the broadening of the ombudsman possibilities regarding the protection in court of the human liberties and rights, appellation to the public prosecutor's office etc.

 

During the discussion the members of the Committee expressed certain remarks to the bill. In particular it was declared that the suggested amendments contradict with the character and purposes of the Ombudsman as an institution, independent state specialized body.

 

According to the article 101 of the Constitution of Ukraine, the aim of the Ombudsman activity is conduction on behalf of the Verkhovna Rada of Ukraine of the Parliamentary control for the state constitutional rights and liberties of citizen. It means that Ombudsman has no authority to give orders to the subjects under control regarding the order of the issues solution that are covered by their terms of reference.
