The Committee on Fighting Organized Crime and Corruption recommends that the Parliament rejects the Bill "On Adoption of the Conception of the Corruption Prevention in System of Courts of General Jurisdiction"

The Bill (Reg.№4220) envisages the adoption of the Conception of the Corruption Prevention in System of Courts of General Jurisdiction.

The Members of the Committee deem the Bill do not correspond to the common images of such a notion as Law and rules of the legislative technique of the law building.

In particular it was declared that the Law is normative-legal act of the highest juridical power that regulates the relations in certain sphere of the social life through the implementation of the compulsory rules of the behaviour of the subjects of these relations. Adoption of the Laws of non-normative content is possible only on cases when it is directly envisages by the Constitution of Ukraine (e.g. in case indicated in part 3 of the article 92 of the Constitution of Ukraine).

The People´s Deputy declared that the task of the suggested bill is only the adoption of the indicated Conception that does not contain the Principles of the normative-legal character.

The People´s Deputies deem that neither of the Conception propositions in case of its adoption would act like legal norm. The Principles of the Conception for their realization need improvement of the certain acts of the effective laws, elaboration of new laws etc.
