The Committee on Public Health, Medical Assistance and Medical Insurance continued its consideration of the draft Law “On Amendments to Article 92 of the Law of Ukraine 'On Medicinal Products' concerning the State Registration of Vaccines or Other Medical Immunobiological Medicine under the obligation” (No. 5247).
The bill is related to the implementation of international agreements to enable Ukraine to receive vaccines for the specific prevention of the Coronavirus COVID-19.
The bill proposes to release manufacturers from liability for the effects of vaccines and immunobiological medicine for the treatment and prevention of COVID-19, which are registered under the obligation for emergency medical use.
During the discussion, MPs warned that the adoption of the bill will not promote vaccination, and thus the formation of collective immunity to coronavirus. It was also stated that everyone should be guaranteed free assistance in case of complications due to vaccination.
The Committee decided to recommend to the Verkhovna Rada, based on the results of the first reading, to adopt the draft law as a basis and in general with the Committee's on Public Health, Medical Assistance and Medical Insurance proposals.
Among the proposals supported by the members of the Committee: to supplement the bill with a provision that medical workers are released from liability for possible consequences if the use of vaccines or other immunobiological medicines was carried out in accordance with the approved instructions, and also provides that, in the event of such consequences, the state ensures the implementation of compensation payments.
In addition, the Cabinet of Ministers must within two weeks from the date of entry into force of this Law to bring regulations in line with the bill, as well as within a month to develop and implement the procedure for making compensation payments.
