The Verkhovna Rada has passed today the following draft bills/resolutions to presently emerge as full-blown pieces of legislation:

 

Bill No.2064: First reading - “On amendments to certain legislative acts of Ukraine as to promoting the development of Ukraine’s winegrowing”.

The bill proposes to establish a minimum period of 25 years for the use of a land parcel as vineyard or for its laying. Appropriate changes will be made to the Land Code of Ukraine and the Law of Ukraine "On lease of land".

 

Bill No.0039 - “On the ratification of the Framework Agreement between the Government of Ukraine and the Government of the Kingdom of Denmark regarding the general conditions and procedures, organizational arrangements and financial terms of the implementation of the Danida Business Finance Programme in Ukraine”.

The ratified document was executed on March 13, 2019 in Kyiv. This Agreement shall enter in force on the date when the Parties have notified each other in writing that their respective internal procedures necessary for its entry into force have been completed.

 

Resolution No.3235 - “On precluding downtime of war veterans’ hospitals when introducing the second phase of the medical reform”.

The parliament recommends that the ministers put off the hospitals switching to the new system of financing through the National Health Service of Ukraine for one year and keep the existing line of funding through the health ministry. The resolution comes into force on the date of its adoption.

 

Bill No.3195: First reading - “On amendments to certain legislative acts of Ukraine as to the refined appointment and dismissal procedure for members of the Cabinet of Ministers of Ukraine”.

The act of law aims to entrust VRU committees and the parliament with the authority to ask the outgoing minister for and hear of a detailed account on his activity while in office.

Appropriate changes will be made to Article 18 of the Law of Ukraine “On the Cabinet of Ministers of Ukraine”, Article 6 of the Law of Ukraine “On central executive bodies”, Article 18 of the Law of Ukraine “On committees of the Verkhovna Rada of Ukraine”, the Verkhovna Rada’s rules of procedure.

 

Bill No.3288: Second reading - “On amendments to Article 9 of the Section VI “Final and Transitional provisions” of the Budget Code of Ukraine because of the adoption of the Law of Ukraine ‘On amendments to certain legislative acts of Ukraine regarding a simplified pre-trial investigation of certain categories of criminal offences’”.

The act aims to harmonize Ukraine’s budget code with requirements of the Law of Ukraine No.2617-VIII on a simplified pre-trial investigation of certain categories of criminal offences. The law shall become effective on the day following its promulgation.

 

Bill No.2255: Second reading – “On amendments to certain legislative acts of Ukraine as to establishing a national intellectual property agency”.

The bill is purposed to set up such an agency/organization (NIPO) as a legal entity under public law (a governmental organization) under the auspices of the Ministry of Economic Development, Trade and Agriculture of Ukraine. This body will be entitled to represent Ukraine internationally and regionally. NIPO’s functions are to be performed by a legal entity under public law (a state organization), set up by a central executive body in charge of framing and actualizing the intellectual property policy of the state, and which is to be designated by the Cabinet of Ministers of Ukraine. The law determines the body’s powers and the NIPO establishment procedure. The law shall enter into force three months after its promulgation, save clause 7 with another date of entry into force.

 

Bill No.2765: First reading - “On amendments to certain legislative acts of Ukraine as to protecting aquatic bio-resources and their habitat”.

The bill aims to stiffen responsibility for misuse/abuse of objects of the animal world, and to heighten accountability for violating protection requirements against their habitat. Ukrane’s penal code will be amended accordingly.

 

Bill No.2655: First reading - “On cloud computing services”.

The bill is aimed at regulating legal relations concerning data processing and data protection when using a cloud computing technology, providing cloud computing services, as well as determining the specificity of using cloud services by public authorities, local governments, military formations, state enterprises, institutions and organizations and other entities to which such powers are delegated. A set of related codes and acts of legislation will be amended accordingly. The draft legislation shall enter into force six months after its promulgation.

 

Bill No.3014: First reading - “On electronic communications”.

The bill is purposed to lay the legal groundwork for activities in the field of electronic communications and radio frequency spectrum, as well as to establish government powers for managing and regulating electronic communications activities, as well as rights and obligations (responsibility) of both individuals and entities engaged in this realm of services.

 

Bill No.2365: First reading - “On protecting migrant workers and fighting against fraud in employment abroad”.

The bill offers replacement of licencing this economic activity (employment abroad) for a mere declaring it by the operators. Listing of these operators is to be conducted by a central executive body in charge of administering the state labour migration and employment policies. There will also be established administrative liability of such operators for breaking the sectoral laws. A set of related codes and acts of legislation will be amended accordingly.

 

Bill No.2618: First reading - “On mine action in Ukraine”.

The bill aims to create a conducive climate to build an effective mine action system equipped with a streamlined single chain of command, without extra funding from the public budget by means of the following tools – (i) setting up a mine action centre – to be routinely funded by the defence ministry, (ii) setting up a humanitarian demining centre – to be routinely funded by the interior ministry, and the like. Appropriate changes will be made the Law of Ukraine “On mine action” currently in force.

 

Bill No.2592: Second reading - “On amendments to the Law of Ukraine ‘On military duty and military service’ as to improving the performance of military service by Ukrainian citizens”.

The bill delists the State Border Guard Service of Ukraine and the Security Service of Ukraine from military formations inapplicable for doing military service by servicemen who have been medically boarded out. 

 

Bill No.2459: First reading - “On amendments to Section X "Final and Transitional Provisions" of the Law of Ukraine ‘On the Households Deposit Guarantee System’ as to facilitating the National Bank of Ukraine to protect the interests of depositors and creditors of insolvent banks”.

The bill shifts the National Bank’s claims against insolvent banks to the fifth round of creditors. This procedure would only be applicable to those banks that were named insolvent as of January 1, 2019 and the liquidating procedure of which is still in progress.

 

Bill No.2493: First reading - “On stock corporations”.

The act aims to harmonize and streamline the stock corporation area of law by introducing electronic election practices when holding a general shareholders meeting; bringing its norms in line with EU law; enabling the launch of a one-tier management system in stock corporations and so forth. Redrafting the stock corporations law is also proposed. A set of related codes and acts of legislation will be amended accordingly.

 

Bill No.2335: Second reading - “On amendments to certain legislative acts of Ukraine concerning recognition as a stateless person”.

The new law establishes the procedure for recognition as a stateless person. The law amends a number of acts of legislation that regulate granting the applicants the right to free secondary legal aid and exempt them from paying court fees and advance payments for the execution of court decisions relating to appeals against decisions on recognition as a stateless person, provide apatrides with opportunities to exercise the right to work and an adequate standard of living. A set of related codes and acts of legislation will be amended accordingly.

 

Bill No.3377: Second reading - “On amendments to certain legislative acts of Ukraine regarding the state support to culture, creative industries, tourism, small and medium-sized businesses in connection with restrictive measures caused by the spread of coronavirus disease (COVID-19)”.

A broad set of related codes and acts of legislation will be amended accordingly with the aim to refresh, update and improve legal relations which have undergone COVID19-related changes of late. Until the end of the year, there will be available kind of government-funded grants-in-aid for certain types of film projects, covering up to 100 per cent of the project’s estimated value. The bill binds the ministers within a month after its entry into force to develop a set of administrative and financial measures aimed at supporting and facilitating Ukraine’s cinema and book-publishing industry as well as COVID19-affected SMEs.     

 

Bill No.3297: Second reading - “On amendments to the Economic Code of Ukraine (as to the elimination of fines and penalties on loans for the period of the quarantine introduced to prevent the spread of coronavirus disease COVID-19 in Ukraine)”.

The bill aims to shield entities against fines and penalties on loans during the quarantine time plus one month thereafter through making appropriate changes to Ukraine’s economic code.

 

Bill No.2030: First reading – “On amendments to the Law of Ukraine ‘On state registration of legal entities, sole proprietors and civil society organizations’ (as to granting the right to a fee-free registration to persons with disabilities and persons who have suffered from the Chornobyl accident)”.

The bill ensures a free state registration procedure for the above categories of citizens.

 

Resolution No.3662 - “On the 2020 Plan of legislative work of the Verkhovna Rada of Ukraine”.

By taking the document, the parliament has thereby approved its legislative work plan for 2020, which contains detailed instructions for VRU committees on how they should organize their work and functioning.

 

Bill No.2553: First reading - “On amendments to certain legislative acts of Ukraine as to introducing into the natural gas market of accounting practices and settlements by volume of gas used in energy units”.

The bill aims to introduce an energy unit principle in natural gas settlements. The laws of Ukraine on the natural gas market and on the customs tariff will be amended correspondingly.
