Today’s enactments in few

The Verkhovna Rada has passed today the following draft bills/resolutions to presently emerge as full-blown pieces of legislation:

 

Bill No.3350: First reading - “On amendments to the Law of Ukraine ‘On debt reorganization of the State Enterprise ‘Antonov’ (as to creating the factors for providing the High Anti-Corruption Court with office facilities)”.

The bill aims to alter the above law through the new Article 11 that allows it to partially settle the debts by means of transferring an Antonov’s non-domestic building to a public authority to be determined governmentally. The market price applicable for such a transfer is to be verified independently.

 

Bill No.3348: First reading - On amendments to the Law of Ukraine ‘On the High Anti-Corruption Court of Ukraine’ for providing the court with office facilities and other operational issues”.

The bill contemplates framing the legal grounds for providing the court with proper office facilities, all in all aiming at doing justice freely. The bill also enables triers for a three-year renewable term of office.

 

Bill No.3361: First reading - “On amendments to certain legislative acts of Ukraine as to the first moves in business deregulation through liability insurance”.

The bill aims to strengthen guarantees for amends to victims in cases that business entities violated laws in force on compliance with the rules of man-made and fire safety. The bill is thought to cover the following measures:

- to arrange the man-made and fire safety inspection procedure for business entities;

- to lower administrative pressure upon business entities through the cancel of mandatory inspection check-ups provided there is presented a third-party liability insurance policy made out to cover any damage from exploiting ‘higher-risk’ facilities;

- to provide guarantees for recovery of damages to life, health, property of third party and the environment resulted from harmful events and accidents that took place on territories, non-movable assets and/or ‘higher-risk’ facilities operating of which might entail emergencies of ecological and epidemic nature;

- to improve the coordination between relevant regulatory bodies, business entities and institutions that ensure providing financial services;

- to streamline the procedure for legal, organizational and financial responding to consequences of events that occurred as a result of man-made accidents and fire situations;

- to harmonize UA law with the legislation of the European Union in the field of security of higher-risk facilities.

The bill intends to change the Laws of Ukraine “On insurance”, “On the basic principles of state supervision (control) over business activity” and the Civil Protection Code of Ukraine.

 

Bill No.3438: First reading – “On amendments to the Law of Ukraine ‘On environmental impact assessment’ as to preventing the emergence and spread of coronavirus disease (COVID-19)”.

The bill is purposed to ensure a virus risk-free conducting of environmental impact assessment activities and related public ventilations/events dedicated to previously filed topical reports. The new provision to the above law stipulates that such ventilations, if any, should be solely done in writing or electronically. This rule is seen to be operative until the end of the established quarantine plus 30 days. These changes also urge to restrain from holding such public events or ventilations during the quarantine period.

 

Bill No.2494 “On amendments to certain legislative acts of Ukraine as to increasing social guarantees for certain categories of persons”.

The new law provides for a greater assistance to children under guardianship or custody. This document also expands the range of persons who have the right to receive state social care assistance (benefits) as per the law on state assistance to persons disabled from the childhood and disabled children, and other categories of persons so entitled to by law. The how-and-when procedures are to be set up by the ministers.

The bill has amended the Law of Ukraine "On employment" and expanded the range of persons in need of additional assistance on employment. At the same time, the list of measures to promote employment has been expanded as well.

 

Bill No.2077: Second reading - “On amendments to the Law of Ukraine ‘On physical culture and sports’ (as to the activity of the Sports Students Union of Ukraine and the Ukrainian Federation of Student Sports)”.

The bill defines the legal status of the union and the federation and determines their powers and ranges of activities.

 

Bill No.2429: Second reading - “On amendments to certain legislative acts of Ukraine as to the elimination of farfetched bureaucratic barriers and corruption-generating factors in the healthcare sector”.

The bill has changed a number of branch-wise acts of legislation to now provide for:

- a faster marketing of generics through triggering off the Bolar provision;

- laying down the legal groundwork for importing unregistered drugs requisite for medical backup of servicemen participating in international safety and peacekeeping missions/operations;

- improving the import procedure for narcotic drugs, psychoactive substances and precursors for their own productions;

- eliminating barriers to up-building the blood service system and putting a ban on exporting donated blood.

 

Bill No.2379: Second reading - “On amendments to the Forest Code of Ukraine as to conducting the national forest inventory”.

The bill aims to introduce national forest-inventory practices and tools as a new nationwide data gathering system on forests. The forest inventory procedure is to be elaborated and established by the ministers.

 

Bill No.2782: Second reading – “On amendments to the Budget Code of Ukraine due to the administrative reform”.

As the State Fiscal Service of Ukraine was formerly subjected to kind of delineation of its authorities and part of them was then delegated to the then newly established Ukraine’s state tax service and state customs service (including all their bodies), both entrusted to carry out state tax and customs policies correspondingly, the new bill has been drafted to bring the corpus of budget code definitions into line with the new reality. To this end, Articles 17, 29, 50 and 64 of the code have been altered accordingly.

 

Bill No.3194: Second reading - “On amendments to the Customs Code of Ukraine due to the public prosecutor’s office reform and changes to the judiciary system of Ukraine”.

The bill alters Articles 456 and 457 of the code in order to harmonize some substantial definitions.

 

Resolution No.3529 - “On amendments to the Verkhovna Rada’s resolution ‘On the holding of 2020 spring session of the NATO Parliamentary Assembly’”.

The document confirms Ukraine’s NATO aspirations as well as approves putting off the session dates till a later date due to the spread of coronavirus disease.

The organizing committee is thereby instructed to develop an action plan for the session within a fortnight term after the new session dates are finally set for. Same term is set for the ministers to finalise the bench of officials to participate in the preliminaries and the holding of the session. The Cabinet is also encharged with funding the said event.

 

Resolution No.3449 – “Address of the Verkhovna Rada of Ukraine to the United Nations, the European Parliament, the Parliamentary Assembly of the Council of Europe, the OSCE Parliamentary Assembly, the NATO Parliamentary Assembly, the BSEC Parliamentary Assembly, national governments and parliaments across the world as to honouring the victims of genocide of the Crimean Tatar people and condemning violations by the Russian Federation as the aggressor state of the rights and freedoms of the Crimean Tatar people”.

The parliament decided to approve the document and instruct the Chairman to immediately forward the text of the resolution to the addressees. This resolution shall enter into force on the day of its adoption.
