Mykola Tomenko: Local Self-Government should be authorized to perform "Social" Notarial Actions

 

On 12 January 2009, Mykola Tomenko jointly with Serhiy Mishchenko, People´s Deputy of Ukraine, registered the Bill "On Amendments to the Law of Ukraine "On Notarial System" (re Authorities of the Local Self-Government Officials concerning Performance of Notarial Actions) at the Parliament.  

 

On 1 October 2008, The Verkhovna Rada of Ukraine introduced substantial amendments to the Law of Ukraine "On Notarial System". Pursuant to the amendments adopted, authorized officials of the local self-government bodies in the settlements without notaries have no right to perform the most widespread frequent "social" notarial actions though initially they were authorized.  

 

Remoteness of settlements from district centers and cities, inadequate transport connections between them, age categories of the rural population (mostly people of retirement age) result in substantial cost of such services, or even in the non-possibility to obtain access to the notarial services, which creates tension in the society.

 

Numerous appeals of the local councils and citizens to The Verkhovna Rada of Ukraine confirm such a situation.

 

The Bill restores the right of authorized officials of the local self-government bodies to perform certain notarial actions in the settlements without notaries. The Bill aims at restoration of social equity concerning residents of settlements and villages.

 

The Bill will facilitate citizens´ access to the notarial services, and reduce citizens´ expenses in the field of civil relations.
