Pursuant to the Bill (Reg. No.2277), bodies of the State executive service obtain an access to the Single State Register of Court Decisions and are authorized to institute proceedings concerning verification of a relevant court decision.
The Committee members stated that introduced amendments were untimely, as currently the regulations of the Law "On Executive Proceedings" concerning access to the decisions of the courts of general competence and conduct of the Register by the State Court Administration of Ukraine failed to be observed. The Parliament members believe that the procedure of formation and conduct of the Register in accordance with the Resolution of the Cabinet of Ministers of Ukraine of 25 May 2006 "On Approval of the Procedure of Conduct of a Single State Register of Court Decisions" is unsatisfactory.
In order to secure implementation of the said Bill, the bodies of the State executive service should be supplied by necessary technical resources, which requires substantial expenditures from the State Budget.
The Committee members believe that adoption of the Bill will make the work of the bodies of the State executive service more complicated, and result in procrastination in instituting executive proceedings.
