The Committee on Legislative Support of Law Enforcement recommends that the Parliament adopts as a Basis the Bill on Amendments to the Criminal Code of Ukraine (re Deprivation of Parental Rights)

The Bill (Reg. No. 3384) introduces a new type of penalty, deprivation of parental rights, in case a person is convicted in the committal of a deliberate crime against his/her child. The Bill introduces relevant amendments to the Criminal Code.  

 

People´s Deputy V.Shvets presented the Bill and reminded that The Verkhovna Rada adopted the Law "On Amendments to the Criminal and Criminal Procedural Codes of Ukraine (re Exploitation of a Child for Begging)" on 1 October 2008. However, it failed to be signed by the President of Ukraine, and was returned to the Parliament.

 

The President stated that the adopted Law failed to envisage any amendments to the sanctions of the clauses of the Special Part of the Criminal Code, which makes it impossible to apply deprivation of parental rights as an extra type of penalty for the committal of a crime. However, the Law states that parental rights can be deprived on the grounds and under the procedure defined by the Family Code of Ukraine.  

 

The Committee members uphold adoption of the said regulation in the version scrutinized by the Committee, "since it will promote creation and enhancement of legal protection of children who suffered from the deliberate crimes committed by their parents".
