Mykola Tomenko informs the Security Service of Ukraine how to fulfill the election slogan of Viktor Yushchenko lawfully.
Mykola Tomenko, Vice-Chairman of The Verkhovna Rada of Ukraine, expressed his concern with the fact that Valentyn Nalyvaichenko, acting Head of the Security Service of Ukraine, lead active political activity.
According to Mykola Tomenko, if law-enforcement bodies are willing to bring People´s Deputies or judges to responsibility, it is necessary to fulfill a specific legal legislatively determined procedure instead of calling them criminals in mass media or declaring election slogans concerning withdrawal of deputies´ immunity at the press conferences, etc.
"I am willing to help the law-enforcement bodies to analyze the procedure of bringing People´s Deputies to responsibility, as it is a matter of principle that Viktor Yushchenko election pledge "Prisons for Bandits" be fulfilled at least after 4 years of his presidency", - stated Mykola Tomenko. However, it is not the Security Service of Ukraine, but the General Prosecution and The Verkhovna Rada of Ukraine that is in charge of bringing People´s Deputies to criminal responsibility.
Therefore, Mykola Tomenko informs the acting Head of the Security Service that it is necessary to act in compliance with Part 3 of Clause 80 of the Constitution of Ukraine and Clause 35 of the Standing Orders of The Verkhovna Rada of Ukraine in order to bring a People´s Deputy of Ukraine to responsibility.
Thus, pursuant to Clause 80 of the Constitution of Ukraine, "People´s Deputies of Ukraine shall not be held criminally liable, detained or arrested without the consent of the Verkhovna Rada of Ukraine".
"Thus, I am interested not in the participation of the acting Head of the Security Service and his team in the political talk-shows, but in actual responsibility of certain officials and People´s Deputies for violation of the Law. As the Vice-Chairman of The Verkhovna Rada of Ukraine, I will exert every effort to convert this discussion from political domain into a legal one", - stated Mykola Tomenko.
