The Committee on Legislative Support of Law Enforcement recommends that the Parliament adopts as a basis the Bill on Amendments to Article 240 of the Criminal Code of Ukraine (re responsibility in the field of subsoil protection and subsoil resources management).
The Bill (Reg. No.2422) specifies features of corpus delicti, envisaged by Article 240 "Violation of Rules of Subsoil Protection" of the Criminal Code of Ukraine, its qualifying features, types and rates of penalties. The People´s Deputies propose that socially dangerous acts be defined in the form of violation of rules of not only subsoil protection, but also of subsoil resources management.
The Bill also considers criminal illegitimate extraction of mineral resources not only of national, but also local importance.
The Committee members believe that adoption of the Bill will promote law and order in the field of management and protection of subsoil resources, mineral resources fields, exertion of preventive and special influence on persons whose occupation is either related, or not related to the extraction of mineral resources.
