The Committee on Legislative Support of Law Enforcement recommends that the Parliament adopts as a Basis the Bill on Amendments to several Legislative Acts of Ukraine regarding Enhancement of Liability for Violation of Graves and other Places of Burial

The Bill (Reg. No. 2160), presented by the People´s Deputy I. Sharov, S. Hryneveckyi and others, proposes that "liability for criminal acts connected with violation of places of burial was brought into concordance with degree of their social danger and extent of infringement of social morality in this field".

                                                                                                                     

The Bill envisages also amendments to the Law " On Burial and Funeral Business" aiming at definition of qualifying requirements of this crime. For the first time the Bill gives clear definition of the concept "violation of grave, other place of burial or body (remains, ashes)".

 

It was proposed to introduce to the Article 297 of the Criminal Code terminology functioning in law currently in force, which gives concrete expression to corpus delicti. In order to eliminate different definitions it has been envisaged to use terms "place of burial", "grave", "grave buildings", which constitute a part of the Law "On Burial and Funeral Business" terminology.
