The Committee on Legislative Support of Law Enforcement recommends that The Verkhovna Rada of Ukraine adopts as a Basis the Bill on Amendments to several Legislative Acts of Ukraine (re Observance of Rights of Arrested or Convicted Persons for unobstructed Correspondence with a Lawyer)

The Bill (Reg. No.2460), submitted by the Cabinet of Ministers of Ukraine, supplements the Law "On Detention on Remand" and the Criminal Executive Code of Ukraine with regulations which prohibit that administrative bodies of penitentiary institutions look over correspondence that arrested or convicted persons send to a lawyer of receive from him.   

 

The Committee members deem necessary to adopt the Bill, as effective regulations of the Law "On Detention on Remand" and the Criminal Executive Code of Ukraine fail to comply with Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms ratified by The Verkhovna Rada of Ukraine on 17.07.1997.

 

Pursuant to the said Article of the Convention, the Parties should secure persons´ right for unobstructed and private correspondence with a lawyer.
