The Bill (Reg.No.1398) proposes to establish the Right, of those deported from Polish territory, to make restitution for the moral and material damage caused to them, and their families, by deportation, which is not envisaged in current legislation.
The Bill states that ‘persons forcedly moved in 1944/5, are recognized as deported together with their families, and the act of moving thus recognized as illegal. Deported persons and their families shall be entitled to seek recompense for the material and moral damage resulting from deportation´.
To compensate for the damage caused to the deported persons and their families, the Sponsor of the Bill, People´s Deputy, M. Kosiv, suggests that the deported persons, irrespective of their year of birth, together with their families, should be entitled to the Benefits envisaged in the Law of Ukraine for War Veterans and their families, ‘On Status of War Veterans and guarantees for their Social protection´.
The Bill requires that property and moral damage caused to the deported persons, and their families, through deportation is covered. The amount of damage covered and the relevant procedure will be defined by the Cabinet of Ministers of Ukraine,
Taking this into account, the Sponsor of the Bill suggests that additional expenditures are allowed for in The State Budget of Ukraine 2009.
