This Bill was prepared by People´s Deputies and Coalition Members, in execution of Paragraph 7, Minutes No.5 of the Meeting, held on 4 February 2008, by The Coalition Council of ‘Our Ukraine/People´s Self-Defence´ and ‘The Yulia Tymoshenko Bloc´ Factions, in The Verkhovna Rada of Ukraine of the 6th Convocation.
It was stressed at the meeting that Members of the Government, Secretariat of the President of Ukraine, Association of Ukraine´s Cities and Communities, and Heads of City State Administrations, were involved in the elaboration on this Bill. Also taken into account were proposals prepared by a Task Force, towards an improvement in Legislation on Public Procurements, set up pursuant to an Order issued by the Ministry of Economy of Ukraine.
During discussions, the People´s Deputies stressed that this Bill, ‘with all its suggestions for legal mechanisms and amendments, is both well-shaped and balanced, and offers an optimal approach to resolving problems arising in Public Procurements, and stabilizing the current situation in this area´.
Committee members also emphasized the importance and topicality of regulating matters related to the improvement of Legislation on Public Procurements.
The outcome of these discussions was a resolution by the Committee, to recommend to The Verkhovna Rada of Ukraine the adoption of this Bill as a basis for further discussions, and during elaboration for the Second Reading, to include all appropriate proposals from the Legal Initiators. Committee members believe that the passing of this Bill, ‘will prove a significant step in regulating problems and stabilizing the situation in Public Procurements, and will positively influence the further development and improvement of the Public Procurement system.
Committee members also referred to the Bill on amendments to the Law, ‘On Public Procurements of Goods, Services and Works´ (Reg. No.1011-19). The People´s Deputies decided that the provisions of this Bill are in conflict with the Constitution of Ukraine, the Laws ‘On Information´, ‘On Protection of Economic Competition´, and other legal enactments. These ‘can considerably impact on Ukrainian legislative harmonization processes, and the fulfillment of commitments taken by Ukraine on signing the Protocol on its Accession to the World Trade Organisation´. Committee members called for rejection of this Bill.
