The Committee on Legislative Support of Law Enforcement recommends that the Parliament adopts in its Entirety the Bill on Amendments to the Procedural Criminal Code of Ukraine (re Intensification of fighting Corruption and Crime in the Field of Official Activities)

The Bill (Reg. No.1281) shifts the right and obligation of holding preliminary investigation in cases of official malfeasance, envisaged by Articles 364, 365, 366, 367, 368, 369, 370 of the Criminal Code of Ukraine, from subject competence of prosecution bodies to alternative competence of all law enforcement bodies that include investigatory powers.

 

The Bill also withdraws preliminary investigation from personal competence of prosecution bodies in cases regarding all the crimes, committed by persons whose positions are related to 1-3 categories of public official positions.

 

Adoption of the Bill will "create sound competition between law-enforcement bodies, which will enhance effective investigation in the field of official malfeasances and corruption fighting".
