The Social Policy and Labour Committee recommends that The Verkhovna Rada of Ukraine adopts, as a basis for further deliberations, the Bill on Social Dialogue in Ukraine

The Bill (Reg.No.1440) introduced by the People´s Deputies, V. Khara, Ya. Sukhyi, and O. Stoyan, proposes to set out the legal principles behind the organisation and maintenance of social dialogue in Ukraine, in terms of enhancing labour and socio-economic relations, and achieving mutual agreement and social harmony within society.

 

The Bill defines the term ‘social dialogue´, its basic principles and scope, and representation of parties, etc. Clause 1 reads: ‘ Social dialogue is a process of defining and approaching positions, reaching joint agreements and adopting coordinated decisions, by those parties to the social dialogue, representing the employees, employers, Executive Authorities and Local Governments, on the issues of implementation of the State Socio-economic Policy and regulation of socio-labour relations.´

 

The Document proposes a procedure for establishment and operation of social dialogue bodies. At National and Territorial level, a National Trilateral Socio-economic Council and Territorial Trilateral Socio-economic Councils shall be set up involving an equal number of representatives from each of the parties.

 

The Bill specifies the representation of the executive power bodies, employees and employers.

 

The Sponsors substantiate the need for adoption of this Bill by the absence of a framework Law appertaining to socio-labour relations, and the required legislative regulation of social dialogue essentials underlying socio-economic progress, improvement in standards of living of the population, and achievement of harmony within society, as well as a definition of the parties to social dialogue, its legal and organisational principles based on those set out in Conventions, and Recommendations of the International Labour Organisation

 

Committee members upheld the Bill, and believe that its adoption will promote a more proactive interaction between the parties to the social dialogue at all levels, and contribute to a more efficient participation in the bargaining processes of the State Officials, employers and Trade Unions.
