The Committee on Family Matters, Youth Policy, Sports and Tourism recommends that the Parliament adopts the Bill "On Amendments to several Laws of Ukraine regarding Family Type Orphanages" in its Entirety

The Bill (Reg. No.2118) excludes the term "a family type orphanage" from the list of preschool educational establishments in the Laws "On Education", and  "On Preschool Education" in order to secure social protection of  parents-educators in family type orphanages, and orphans and children deprived of parental care who are brought up in such families.  

 

Pursuant to the Family Code, the Laws "On Provision of Organizational and Legal Conditions of Social Protection of Orphans and Children deprived of Parental Care", "On Protection of Childhood", a family type orphanage is a separate family created according to the choice of a married couple or a single person who take not less than 5 orphans or children deprived of parental care for upbringing and common residence.   

 

However, the Laws "On Education", and "On Preschool Education" regard a family type orphanage as a preschool educational establishment.  

 

The Committee believes that adoption of the Bill will eliminate legal inconsistency and coordinate these two Laws with the Family Code of Ukraine, the Laws "On Provision of Organizational and Legal Conditions of Social Protection of Orphans and Children deprived of Parental Care", and "On Protection of Childhood".
