Under consideration in The State Building and Local Self-Government Committee is a Bill amending The Law of Ukraine, 'On Local State Administration', introduced by The President of Ukraine

The Bill ( Reg. No. 1311) regulates, at a legislative level, problems faced by Local State Administrations in exercising their Authorities, stemming from contradictions between various provisions in the current Law, 'On Local State Administrations', and provisions of the Laws, 'On Local Self-Government in Ukraine' and 'On the Cabinet of Ministers of Ukraine'.

 

The suggested amendments to the Law 'On Local State Administrations' clarify the status of the Chairman of the Local State Administration, provisions on the procedure for the formation of Local State Administrations, and delineate the functions of The President of Ukraine and The Cabinet of Ministers in this area. The Bill also advocates that ‘In the formation of the body of the Heads of Local State Administrations a personnel focused approach is used. The Head of a Local State Administration shall be appointed from among those who are on The Personnel Reserve List of candidates suitable for the occupying of positions of Heads of Local State Administrations (selection to said List being decided on a competitive basis), or by a transfer of someone who, at the time of this appointment, is Head of another Local State Administration'.

 

According to the provisions of the Bill, The Cabinet of Ministers of Ukraine shall submit to The President of Ukraine a Representation for the Termination of Authorities of a Head of a Local State Administration, on the grounds as listed in Paragraph 7, Part 2 hereunder, no later than one calendar month before the expiration of the Term of Office of the Head of The Local State Administration, as laid down in this Law. At the same time there will be a Representation to appoint this person to the position of Head of another Local State Administration, or a submission as to the consent of this person to take up an appointment to another position within the Civil Service.
