Before making a final decision on the ratification of the Rome Statute and the terms of its entry into force it is necessary to thoroughly study the best practices, Deputy Chairperson of the Committee on Legal Policy and Justice Serhii Alekseyev said after the meeting with representatives of the "Parliamentarians for Global Action" international network.
"The
decision on the ratification of the Rome Statute and the terms of its entry
into force is very important for Ukraine, since it is one of the conditions of
the Association Agreement with the EU. Therefore, before its approval it is
necessary to study international experience and of Georgia in particular, which
faced unexpected consequences after the ratification of the Rome Statute,"
he said.
Serhii Alekseyev reminded that according to the transitional provisions of the
proposed by the President of Ukraine amendments to the Constitution as regards
justice, the Rome Statute will enter into force in three years after its
ratification. This precaution, he says, is due to, in particular, negative
experience of Georgia, when Russia after the military actions in the territory
of this country, distorting facts, started throwing lawsuits against the
Georgian military at international institutions.
"To remove such precautions is only possible by demonstration of the
practical application of the International Criminal Court's provisions, and
that the ratification of the Rome Statute may assist in bringing to justice
those who committed crimes against humanity, war crimes. In addition, the Rome
Statute may serve as a certain safeguard against such actions in the
future," he said.
Serhii Alekseyev also noted that President of Ukraine Petro Poroshenko
advocates the speediest adoption of the amendments to the Constitution both in
regard to decentralization, and in regard to justice. This, according to his
words, will let Ukraine move forward, that is why the faction of the Party
"Petro Poroshenko Bloc" will do its utmost to speed up consideration
of the relevant draft laws.
