At a November 11 meeting chaired by the Committee Chairperson Iryna Heraschenko the Committee members examined a number of draft laws regarding their compliance with the law of the European Union, Ukraine's commitments in the framework of the Council of Europe and the Association Agreement between Ukraine on the one part, and the European Union, the European Atomic Energy Community and their member states on the other part.
In particular, the Committee members identified draft laws Nos. 2216, 2009a, and 3442 as not contradicting the law of the European Union, the Association Agreement and the international legal commitments of Ukraine in the framework of the Council of Europe.
Draft law No.2216 proposes to introduce a concept of "information acquirer" to define an entity that actually as of today technologically provides the process of organization of electronic creation and submission by entities of control tapes to the revenue and fee authorities; to define personalization of payment transactions registrar as a stage of their putting into operation; to free entities from liability envisaged by the legislation if the violation occurred because of the information acquirer.
Draft law No.2009a is aimed at creating in Ukraine legal and institutional framework for assessing the impact on the environment. The draft law proposes to compile the list of facilities subject to mandatory procedure of environmental impact assessment and to introduce the EIA model, which includes reporting on environmental impact assessment by the entity; public discussion; examining and analysis by the authorized body of the information provided in the report on the environmental impact assessment, of any extra information provided by the entity, as well as information received during the public discussion and resulting from cross-border impact assessment if any; provision by the authorized body of a reasoned decision on the EIA; taking into account of this decision in the permit, which serves as a basis for the start of the planned activity realization (final decision).
The adoption of the draft law No. 3442 will contribute to the fulfillment by Ukraine of the recommendations on the fifth report of the European Commission on Ukraine's implementation of the Action Plan on liberalization of the EU visa regime for Ukraine.
The Committee members declared draft laws Nos.1665, 2889 and 2503 as formally not contradicting the legislation of the European Union and the Association Agreement, but at the same time they need clarification and revision till full compliance with Ukraine's commitments in the framework of the Association Agreement.
Adoption of draft laws Nos.1665, 2889 will promote bringing Ukrainian legislation in line with the European environmental legislation, strengthening protection of territories and facilities of the natural reserve fund, and strengthening the fight against poaching.
The task of the draft law No.2503 is the integration of provisions on protection of business competition in the field of air transportation into the main legislative act regulating this legal relationship, namely the Air Code of Ukraine. In addition, the draft law is aimed at the withdrawal from the Air Code of Ukraine of provisions containing anticompetitive signs.
However, the deputies decided to address the Government with a request to provide the relevant expert opinion on the draft law No.1623.
The Committee members declared draft laws Nos. 2211a and 2085a as contradicting the law of the European Union.
