The Industrial and Regulatory Policy and Entrepreneurship Committee Recommends the Parliament to Accept as a Basis

As it was mentioned at the committee meeting, the Bill (Reg. No. 3391) suggests introducing new principles of licensing that will make it impossible both to groundlessly subject new types of economic activity to licensing and to withdraw certain types of economic activity from the scope of the Law "On the Licensing of Certain Types of Economic Activity".

 

The idea of amending the law consists in the following: unifying the licensing procedure by preserving the specific character of licensing of certain types of activity, which is determined by special laws. To that effect it is suggested to establish the principle of the predominant application of the regulations of the basic law about licensing in the laws that regulate the relations in corresponding fields.

 

In order to prevent the unjustified expansion of the types of economic activity that are subject to licensing, the Bill suggests introducing the requirement, according to which the licensing can be established only when economic activities can not be regulated either by effective regulatory bills or by amendments to them. This will enable reduction of the State intrusion into the activity of the business entities as well as the obviation of obstacles in the development of economic activity, which is carried out within the scope of the Constitution and the laws of Ukraine.

 

The Bill suggests partial limitation of the type of economic activity concerning development, probation, production, operation of the carrier rockets, spaceships and their components, ground-based space-system infrastructure and its components, equipment that constitutes the space-based part of satellite systems.

 

Such limitation of the scope of licensing will permit to expand substantially the possibilities of exploiting the results of space activity due to launching new satellite receiving stations, creating corporate systems of satellite communication, expanding Internet network and satellite television. Thus, the zone and the extent of transmitted information, and, correspondingly, of the number of the information users will expand.
