ON TUESDAY, 6 JULY THE PLENARY MEETINGS OF THE SIXTH SESSION OF THE VERKHOVNA RADA OF UKRAINE OF THE SIXTH CONVOCATION WERE HELD

 

At the beginning of the morning sitting, Volodymyr Lytvyn, the chairman of the Verkhovna Rada of Ukraine informed on the results of the work of the Parliament during the plenary meetings on 29 June 2 July.

 

The authorised representatives of the Deputies Factions delivered the announcements, appeals and propositions.

 

The Bill on Amendments to the Code of Ukraine on Administrative Infringements regarding the Implementation of the Liability for the Breach of the Order of the Licensing Document Issuance was reported by the Chairman of the State Committee on Regulatory Policy and Entrepreneurship Mykhailo Brodskii. He stated that the bill suggests new version of the clause 164 of the Code on Administrative Infringements, pursuant to which, submitting of designedly false data for the state registration of the legal entities or individual persons - entrepreneurs or obtaining the license on certain type of the activity etc. entails the penalty from twenty to forty tax-exempt minimum.

 

Vasyl Hrytsak, the Chairman of the Sub-committee of the Committee on Legislative Support of Law Enforcement informed on the Committee decision to the recommend the Parliament direction of the bill for the further drafting.

 

In the result of the voting the bill was adopted as a basis.

 

The People´s Deputies scrutinized the bill on Amendments to the Law "On Joint Stock Companies" (regarding the Improvement of the Mechanism of the Joint Stock Companies Activity." The bill was reported by Yu. Voropaev, Deputy Chairman of the Committee on Economic Policy.

 

The Parliamentarians adopted the bill as a basis by 260 votes.

 

The Verkhovna Rada passed the Resolution "On Recognition as such that lost its Efficiency the Resolution of the Verkhovna Rada of Ukraine "On Appointing of the Title "Ukraine" to the Cruiser (Reg. No1164, No2011)" and Resolution "On Withdrawal from the Drafting of Certain Bills on taxation."

 

In the result of the scrutiny the draft resolution on celebration on the state level of 100th anniversary of the Ukrainian medical society was rejected.

 

Parliamentarians scrutinized a number of amendments to the bills in the second reading. In the result of the scrutiny the following bills were adopted in the entirety as the laws: "On Amendments to certain Laws of Ukraine", "On Amendments to Clause 218 of the Code of Ukraine on Administrative Infringements" (re Specification of certain Principles regarding Jurisdiction of Cases on Administrative Infringements in the Trade and Service Sectors), "On Amendments to the Law of Ukraine "On State Secret", "On Mobilization Preparation and Mobilization" (re Notification about the Mobilization Tasks (Orders), "On Amendments to certain Legislative Acts of Ukraine", "On Amendments to certain Laws of Ukraine regarding Issue of Production Permits."

 

The Verkhovna Rada passed the Resolution "On Declaration of the Verkhovna Rada of Ukraine "Real Guarantees for Nuclear-Free Status of Ukraine."

 

The People´s Deputies forwarded for the further drafting the bill on amendments to certain legislative acts of Ukraine of migration matters.

 

The scrutiny of the following bills was postponed: on amendments to certain legislative acts of Ukraine on military service matters, social protection of the military officers and their family members; on amendments to the item "з" of the subparagraph 4.4.2 item 4.4 clause 4 of the Law "On Order of liquidation of tax payer obligations before the state and budget trust funds"; on amendments to certain laws of Ukraine (regarding the taxation of the income form the operation of buy-back of used goods).

 

The Verkhovna Rada of Ukraine adopted the Law "On Ratification of the Loan Agreement (Additional Funds for the Implementation of a Project on the Reconstruction of Hydroelectric Power Plants) between Ukraine and the International Bank for Reconstruction and Development (IBRD) and Support Letter No1 to the Loan Agreement (regarding the Finance and Economic Data) and Support Letter No2 to the Loan Agreement (regarding the Monitoring Indices)."

 

The Parliamentarians agreed to the obligatoriness of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data and the Additional Protocol to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data regarding supervisory authorities and Transborder Data Flows; the Treaty between the Cabinet of Misters of Ukraine and the Government of the Republic of Poland on the Introduction of the Amendments to the Agreement between the Cabinet of Minister of Ukraine and the Government of the Republic of Poland on Cooperation in the course of the Control of Persons, Goods and Transport Vehicles crossing the Ukrainian-Polish Frontiers, signed on 25 June 2001 in Kyiv.

 

The People´s Deputies scrutinized and adopted the Law "On Accedence to the Grains Trade Convention."

 

The People´s Deputies postponed the scrutiny of the bills on amendments to certain Laws of Ukraine (regarding the implementation of new standards and radio technologies) and on amendments to the Law "On Pension provision for the Persons dismissed from  the Military Service and certain other persons" (regarding the pension rate in case of breadwinner loss).

 

Kateryna Samoilyk, Secretary of the Committee on Science and Education reported on the decision of the Committee regarding the draft resolution

Pursuant to the resolution, the Cabinet of Ministers of Ukraine is supposed to inform the Verkhovna Rada of Ukraine till 15 December 2010 on the state of the implementation of the Parliamentary Hearings Recommendations.

 

The participants of the hearings "Introduction of a twelve-year compulsory secondary education in Ukraine: problems and ways of their solution" recommend:

The Verkhovna Rada of Ukraine is supposed to continue the work regarding the improvement of the legislative regulation of the secondary compulsory education, providing its availability, completeness and being free-of-charge, inner economical effectiveness, correspondence to new conditions of production and labour market, introduction to the state educational policy the weight corrections, adequate to the present realities and world tendencies;

provide introduction of the amendments to the Laws of Ukraine "On Compulsory Secondary Education" in the part of the implementation of 11-year term of studying in schools and the Law of Ukraine "On Nursery Education" in the part of the implementation of the compulsory nursery education from 5 years age.

 

The Cabinet of Ministers of Ukraine, Central Bodies of the state executive bodies Ministry on Economics of Ukraine, Ministry on Finance of Ukraine, Ministry on Education and Science of Ukraine, Ministry of Health Protection of Ukraine are recommended to:

take necessary measures to order the networks, improve the state of engineer communications in the secondary educational establishments, coordination with the social and economic structure of the regions, formation of the conditions for the differentiation of the senior pupils;

Local bodies of the state executive bodies, local self-government bodies are recommended:

provide functioning of the complete network of the educational establishments according to the needs of the population. Renovate the work of the temporary closed educational institutions. Form the conditions for the implementation of the compulsory education for children aged five

etc.

 

K. Samoilyk announced that taking into the consideration all the propositions, one more issue remains: whether to impalement 11-year or 12-year system of the secondary compulsory education or not. The Committee suggests that the Parliament adopts the 1-year educational system.

 

The People´s Deputies upheld the proposition, thought here were certain objections.

 

The Parliamentarians adopted the recommendations of the Parliamentary Hearings by 267 votes.

 

K. Samoilyk, reported the bill "On Amendments to the Legislative Acts of Ukraine regarding the Issues of the Compulsory Secondary and Preschool Education (regarding the Organisation of the School-Educational Process)." She declared that the legislative cat introduces the amendments top the Law "On {preschool Education" pursuant to which, the compulsory preschool education for the children of the elder preschool age is implemented and to the Law of Ukraine "On Compulsory Secondary Education" in the part of the implementation of 11 year term for the complete compulsory secondary education, standardization of the educational establishments types, implementation of inclusive education of children with the special needs.

 

The opponents of the bill emphasised that one of the bill drawbacks is the implementation of compulsory nursery school from 5 year age.

 

The Verkhovna Rada of Ukraine adopted the bill as a basis and in its entirety by 248 votes.

 

The People´s Deputies scrutinized and adopted as a basis "On Town Planning and Organization of Public Services" (regarding the Issue on Small Architectural Forms).

 

Anatolii Semynoha, the Chairman of the Committee on Environmental Policy, Use of Natural Resources and Elimination of Consequences of Chornobyl Disaster reported the decision of the Committee to recommends the Parliament adoption of the bill "On Amber" as a basis. He stated that the bill was drafted to secure effective State regulation of amber extraction in Ukraine. The bill alleviated the procedure for obtaining special permits for using mineral resources to extract cob amber from the non-industrial fields and developments in Prypiat succiniferous district. The bill amends the Law "On State Regulation of Extraction, Production and Use of Precious Metals and Supervision over the Operations with them" and the Criminal Code of Ukraine.

 The bill envisages free use of succiniferous resources in the non-industrial fields and developments, as well as extraction of amber cob at the land plots in the ownership of the citizens performing the extraction.  

 

A. Semynoha indicated that the economic activity of legal entities, individual entrepreneurs and citizens connected with the extraction of amber cob, procession and manufacture of products from amber cod and sale of products from amber cod is not subject to licensing. The bill includes regulations concerning violation of rules of extraction, transportation and sale of amber.

 

In the result of the voting the bill was adopted as a basis by 264 votes.

 

The Verkhovna Rada of Ukraine adopted as a basis the bills - On Telecommunication" (regarding the defining of the Telecommunication Access Services Market), "On Telecommunications" (re Access to the Cable Duct-Work of Telecommunication).

 

The Parliamentarians scrutinized and adopted the Bill "On Securities and Stock Market" (re Creation of Conditions for preventing "Technical" Defaults in Bonds) as a Basis.

 

The People´s Deputies voted for the prolongation of the afternoon meeting till the completion of the agenda issues drafting and for the conduction of the afternoon sitting on Wednesday.

In the course of the afternoon sitting the People´s Deputies scrutinized 671 amendments to the bill on Amendments to the Budget Code of Ukraine. The Final decision regarding the bill, he Verkhovna Rada shall adopt on Thursday, 8 July.

 

The chairman adjourned the afternoon sitting.

 

Next plenary meeting shall be held on Wednesday 7 July.
