THE PLENARY MEETINGS OF THE VERKHOVNA RADA OF UKRAINE OF THE SIXTH CONVOCATION WERE HELD ON TUESDAY

 

At the beginning of the plenary meeting, Volodymyr Lytvyn, Chairman of the Verkhovna Rada of Ukraine, announced the results of work of the Verkhovna Rada of Ukraine during the plenary meetings on 11-14 May.

 

The Law "On Amendments to certain Legislative Acts of Ukraine regarding Prevention and Counteraction to Legalization (Laundering) of Illegally Obtained Income and Terrorism Financing" in the New Version with the motions of the President of Ukraine was presented by Stanislav Arzhevitin, First Deputy Chairman of the Committee on Finance and Banking.

 

He stated that the law extends the list of subjects of primary financial monitoring with notaries public, attorneys, subjects of entrepreneurship that render legal services, real estates traders (realtors), mail service operators (in the part of money transfer), traders of precious metals and jewels, auditors, auditing companies, legal entitles that hold any lottery, subjects of entrepreneurship that render accounting services, and some other representatives of non-financial occupations. The Bill also supplements the list of public bodies authorized to supervise the subjects listed above the ministry of justice, finance, economy, transport and connections.

 

 The law was drafted to secure realization of regulations of a new version of Forty Guidelines of the Group in charge of Development of Financial Actions on Money Laundering Prevention (FATF), adopted at Berlin meeting of the Group in June 2003, the Council of Europe Convention on laundering, search, attachment and confiscation of fraudulent gains, and terrorism funding, and also the Guideline of the European Parliament and the Council 2005/60/EU on prevention of use of financial system with the purpose of money laundering and terrorism funding.

 

Relevant amendments are based not only on the Forty Guidelines of the FATF, but also on the Convention on Laundering, Search, Seizure and Appropriation of Illegally obtained Income ratified by The Verkhovna Rada of Ukraine on 17 December 1997.

 

The parliamentarians scrutinized the amendments and adopted the Law "On Amendments to certain Legislative Acts of Ukraine regarding the Prevention and Counteraction to Legalization (Laundering) of illegally obtained Income and Terrorism Financing" in the New Version by 356 votes.

 

The bill on Amendments to Certain Legislative Acts of Ukraine regarding Licensing of Certain Types of Economic Activity was presented by Natalia Korolevska, Chairperson of the Committee on Industrial and Regulatory Policy and Entrepreneurship. She stated that the bill (Reg. No.6153) enhanced licensing procedure by setting common criteria for enlisting certain types of economic activity to the registry of activities subject to licensing.

 

Pursuant to Clause 3 of the effective Law, a certain type of activity shall be subject to licensing if it meets one of the following criteria: danger to life, health, constitutional rights and liberties of a citizen or to the environment, state safety and public morality; connection with the access to natural or other restricted resources.

 

The bill also amends the Law "On Licensing of certain Types of Economic Activity" and certain legal-normative acts, excluding the types of economic activity that fail to meet the set criteria and effective principles of licensing from the registry of activities subject to licensing.

 

Governmental motions and suggestions of Yu. Karmazin considered, the bill was adopted as a basis by 314 votes.

 

The bill on Amendments to the Law "On Fundamentals of State Supervision (Control) in the Economic Activity Sector" (re Harmonization of Certain Provisions) was presented by People´s Deputy Valerii Konovaliuk. He stated that the bill introduces amendments to the effective Law that establishes the principle of state supervision, under which only one supervision body shall be present in the central executive authority body. Moreover, the list of grounds for the conduction of early supervising actions is supplemented with a new reason (accident or death due to an accident or a professional illness), and a term of at least 30 working days is set for the business entity to eliminate legislation infringements.

 

The People´s Deputies adopted the bill as a basis.

 

The Verkhovna Rada of Ukraine adopted the Law "On Amendments to the Criminal Procedural Code of Ukraine" (re Harmonization of Jurisdiction with the Competence of the Law-Enforcement Bodies).

 

The bill "On Amendments to certain Legislative Acts of Ukraine" (re Dismissal of Judges elected for an Indefinite Term) was presented by Dmytro Petryk, member of the Committee on Justice.

 

The bill was adopted as a basis.

 

The Verkhovna Rada adopted the bill on amendments to the Law "On Youth and Children Public Associations" (re Age Limit, Participation in Election Coalitions).

 

The bill on amendments to certain laws of Ukraine (re introduction of new standards and radio technologies) was forwarded for further drafting.

 

The People´s Deputies postponed scrutiny of the bill on amendments to certain legislative acts of Ukraine regarding governmental welfare aid to the low-income families and people with disabilities.

 

The bill on amendments to certain legislative acts of Ukraine (re social security of the employees of public health, cultural and social security institutions) was rejected.

 

In the beginning of the afternoon plenary meetings, the People´s Deputies scrutinized the bill "On Adoption of the Resolution of the President of Ukraine on the Reception of Foreign Armed Forces in the Territory of Ukraine in 2010 for the Participation in Multinational Military Training."

 

The Verkhovna Rada adopted the bill by 394 votes.

 

People´s Deputy Yurii Prokopchuk presented the bill on amendments to the Codes of Laws on Labour of Ukraine (re registration of the labour agreement).

 

The bill was adopted as a basis and in its entirety by 363 votes.

 

The People´s Deputies scrutinized two bills on amendments to the law "On the State Decorations of Ukraine": Reg. No. 3346 and Reg. No. 5142.  

 

Both bills were rejected.

 

The Verkhovna Rada rejected the bill on amendments to clause 27 of the Law "On Higher Education" (re foundation of educational institutions with the involvement of foreigners, individuals and legal entities).

 

The bill on amendments to clause 240 of the Criminal Code of Ukraine (re responsibility in the field of protection and use of mineral resources) was withdrawn.

 

The People´s Deputies scrutinized and adopted the bill on amendments to clause 218 of the Code of Ukraine on Administrative Infringements (re specification of certain principles regarding jurisdiction of cases on administrative infringements in the trade and service spheres).

 

The bill on amendments to the Code of Ukraine on Administrative Infringements (re obligatory treatment of alcoholism, drug addiction or toxic substance abuse) was rejected.   

 

V.Lytvyn, Chairman of The Verkhovna Rada of Ukraine, adjourned the afternoon plenary meeting.

 

The next plenary meeting shall be held on Wednesday, 19 May.
