ON WEDNESDAY 14 APRIL THE PLENARY MEETING OF THE SIXTH SESSION OF THE VERKHOVNA RADA OF UKRAINE OF THE SIXTH CONVOCATION WAS HELD
Volodymyr Lytvyn, the Chairman of the Verkhovna Rada of Ukraine briefed on the results of the Verkhovna Rada of Ukraine work during plenary meetings on 30March 1 April.
The representatives of the Deputies´ factions read announcements, propositions and appeals.
The Bill on Amendments to the Clause 217 of Criminal Procedural Code of Ukraine" (regarding the Duties of Criminal Investigator) was reported by Serhii Mishchenko, the people´s Deputy of Ukraine. He informed that the Bill suggests the implementation of the fact that in the course of bringing the pre-trial hearings materials the criminal investigator is obliged to hand after the demand of victim, civil claimant, civil defendant or their representatives attested copy of pre-trial investigation materials, that is recorded in the minutes on end of investigation and on bringing the materials of the case. It adoption would facilitate the strengthening of the protection of human and citizens constitutional rights.
Volodymyr Moisyk, the Chairman of the Sub-Committee of the Committee on Legislative Support of Law Enforcement announced that the Committee recommends that the Parliament adopts the bill as a basis.
In the result of the voting the People´s Deputies adopted the bill by 378 votes.
Sviatoslav Oliinyk, the People´s Deputy of Ukraine presented the Bill on Amendments to certain Laws of Ukraine regarding the Non-admission of Right for Appeal Abuse. He stated that the Bill is aimed at the counteraction of right to appeal abuse in cases, the subjects of which are the acts of the Supreme Council of Justice. The Bill suggests the amendments to the Law "On Supreme Council of Justice" and Code of Ukraine on Administrative Legal Proceedings and implements that acts of the Supreme Council of Justice might undergo appellation in the Supreme Administrative Court of Ukraine.
Vadym Kolesnichenko, the Chairman of the Committee on Justice reported the decision of the Committee to recommend the Verkhovna Rada adoption of the bill as a basis.
In the result of the scrutiny the bill was adopted as a basis by 236 votes.
The People´s Deputies shifted the scrutiny of two bills of the agenda to the next week on amendments to the clause 1 of the Law "On State Support and Peculiarities of Functioning of "Artek" and "Moloda Hvardia" Children Centers and on amendments to the Law "On Television and radio broadcasting" (regarding the National television and radio companies of Ukraine)."
The Bill on Amendments to the Law "On Advertising" (regarding the Identification of the Social Advertising and Regulation of Separate Types of Political Parties and Public Organisations Advertising) was reported by Olena Kondratiuk, the Chairperson of the Sun-committee of the Committee on Freedom of Speech and Information. She explained that the Bill suggests entitlement of public organisations with the right on independent solution of the issue regarding placement in their advertisement of the relevant references to the advertiser, in case they order social advertisement. The document envisages implementation of the fact that state body if it is a advertiser of the social advertisement is obliged to present a relevant reference in the advertisement.
Pursuant to the bill, social advertisement that is being broadcasted to the order of state power bodies and local self-government bodies is not supposed to contain information that facilitates the formation of interests in a certain political party, electoral bloc, their programs, agreements, political actions that are conducted of upheld by them, leaders or members of certain political party or electoral bloc.
According to the document, advertiser of political actions, leaders or members of the political party may be political parties, their structural centres and also citizens of Ukraine, possessing Constitutional voting right. The bill implements the threshold price rate that may be used by the citizen for the advertising with the information on program. political events (activity), leaders or members of the political party; also it implements the prohibition on circulation of mentioned above advertisement on the behalf, but without the consent of the relevant political party; defines the cases of prohibition of imitation or copying of the party symbols.
The People´s Deputies adopted the bill as a basis by 353 votes.
Volodymyr Moisyk, the Chairman of the Sub-Committee of the Committee on Legislative Support of Law Enforcement presented the Bill on Circulation of Weapon of Non-Military Designation. He stated that the Bill defines the basic types of weapon and establishes a single procedure of purchase, upkeep and use of service and civil weapon. The Bill is adopted in view of the fact that despite the definite constitutional regulations, the subordinate legislation, especially departmental instructions of the Ministry of Internal Affairs, still regulates the issues concerning acquisition of the right of ownership of weapon of non-military designation, peculiarities of its upkeep, use, inheritance and alienation.
The People´s Deputy emphasised that the Bill does not presuppose that the citizens shall have the right to purchase, keep and carry short-barreled rifled firearm for self-defence. The Bill reduces the age requirement for the right to purchase, keep and carry smooth-bore hunting firearms, the self-defence weapon for the citizens of Ukraine from 21 to 18 years of age, which complies with the requirements of the civil legislation. Its adoption will enhance safety of economic entities and other individuals and legal entities provide further development of entrepreneurship.
In the result of the scrutiny the Bill was adopted by 318 votes.
The Verkhovna Rada of Ukraine rejected the bill on amendments to the clause 5 and 8 of the Law "On State Social Aid to the Low-Income Families" (regarding the assistance at the rate of minimum subsistence level).
The People´s Deputies failed to include into the agenda of the sixth session the bills: on amendments to the Law "On Preliminary Actions on Prevention of Negative Consequences of Finance Crisis" (regarding the formation of the anti-crisis state consumer and medical baskets); on amendments to the Law "On State Aid to the Families with Children" (regarding the state aid for the upbringing of child from 3 years age) and on amendments to the clause 12 of the Law "On Military Service and Duty."
Volodymyr Lytvyn, the Chairman of the Verkhovna Rada of Ukraine adjourned the morning meeting.
Next plenary meeting of the sixth session will be held on 15 April, Thursday.
