PLENARY MEETINGS OF THE SIXTH SESSION OF THE VERKHOVNA RADA OF UKRAINE OF THE SIXTH CONVOCATION WERE HELD ON 16 FEBRUARY
In the beginning of the morning plenary meeting, Volodymyr Lytvyn, Chairman of The Verkhovna Rada of Ukraine, briefed on the results of work of The Verkhovna Rada of Ukraine at the plenary meetings on 9-12 February.
The Chairman announced that on 15 February 2010 the Central Election Committee registered the People´s Deputy of Ukraine, elected on 30 September 2007, Matchuk Viktor Yosypovych, "Our Ukraine - People´s Self-Defence" Bloc.
Newly elected People´s Deputy put on his oath before the Verkhovna Rada.
The Pepole´s Deputies scrutinized the Resolution "On Amendments to the Schedule of the Sixth Session of The Verkhovna Rada of Ukraine of the Sixth Convocation due to the Grand Meeting dedicated to the Oath-Taking of a Newly-Elected President of Ukraine" (25 February 2010).
The People´s Deputies amended the schedule of the sixth session of The Verkhovna Rada of Ukraine of the sixth convocation adopted by the Resolution of The Verkhovna Rada of Ukraine on 19 January 2010.
Pursuant to the amendments, the grand meeting dedicated to the oath-taking of a newly-elected President of Ukraine shall be held at 10 a.m. on 25 February 2010 at the session hall of The Verkhovna Rada of Ukraine in compliance with Clause 104 of the Constitution of Ukraine and the Resolution of The Verkhovna Rada of Ukraine of 14 December 2004 "On the Holding of the Grand Meeting dedicated to the Oath-Taking of a Newly-Elected President of Ukraine".
The Verkhovna Rada passed the Resolution Draft by 238 votes.
The Resolution "On Invalidation of the Resolution of The Verkhovna Rada of Ukraine "On Regular Elections of the Deputies of Local Councils and Village, Settlement and City Mayors in 2010" was reported by Yurii Karmazin, the People´s Deputies of Ukraine.
He stated that the resolution Draft invalidates the Resolution of The Verkhovna Rada of Ukraine "On Regular Elections of the Deputies of Local Councils and Village, Settlement and City Mayors in 2010" of 20 October 2009 No.1648-VI.
He also briefed that the Committee on State Building and Local Self-Government is commissioned to submit relevant motions due to the Resolution of the Constitutional Court No.13рп-2009 of 4 June 2009 on the case related to the institution of constitutional proceedings by Kyiv City Council for the official interpretation of Part 1 and 1 of Clause 141 of the Constitution of Ukraine. The Committee shall also bring forward the Bill on the alteration of the system of local elections.
The Peoples´ Deputies in general upheld the legislative proposition of Yurii Karmazin and emphasized that the issue on elections postponing is complicated and presupposes amendments to the Constitution of Ukraine.
In the result of the discussion, the Verkhovna Rada of Ukraine passed the Resolution "On Invalidation of the Resolution of The Verkhovna Rada of Ukraine "On Regular Elections of the Deputies of Local Councils and Village, Settlement and City Mayors in 2010" by 250 votes in favor.
The Bill on the State Migration Policy Concept was reported by Valeriia Lutkovska, the Deputy Minister on State Migration Policy. She explained the basic principles of the governmental Bill.
The alternative Bill was presented by Yurii Karmazin. The Draft Concept determines the following: terms, legal principles, goals and fundamentals of the State migration policy of Ukraine; basic principles of migration processes regulation; restrictions in the field of migration and responsibility for illegal migration; objectives of the public authority bodies concerning realization of the State migration policy of Ukraine; priorities of the State migration policy of Ukraine; information and financial support of the State migration policy; international cooperation in the field of migration.
Yurii Hnatkevych, the Chairman of the Subcommittee of the Committee on Human Rights, National Minorities and International Relations briefed that the Committee have scrutinized both Bills though failed to adopt the decision concerning both Bills.
In the result of the scrutiny the Bill of Y. Karmazin was adopted as a basis and the governmental one was rejected.
The Verkhovna Rada of Ukraine adopted as a basis and in its entirety the Bill "On the Social Security of the Children of War" (re the Right for the Hospital Medical Treatment at the Hospitals for War Veterans).
The Parliamentarians rejected the Bill on amendments to the Law "On Immortalization of the Great Patriotic War 1941-1945 Victory" (regarding the order of the official use of authentic copies of Victory Flag).
The Bill on amendments to the clause 7 of the Law "On the State Social Aid to Low-Income Families" was directed for the further elaboration.
The Bill on Amendments to Clause 25 of the Law "On Leaves" (re a Guaranteed Leave for one of the Parents for the Period of Quarantine) was reported by Oleh Zarubinskyi, the People´s Deputy. He declared that pursuant to the Bill, one of the parents of a child before 7 years of age is entitled to an extra leave without pay for the period of quarantine at a corresponding territory.
The Profile Committee on Social Policy and Labour recommended the Parliament adopts the Bill as a basis. It was announced by Svitlana Shmeliova, the Chairperson of the Subcommittee of this Committee.
The Bill was adopted by 348 votes and directed for the elaboration for the second reading according to the reduced procedure.
The Bill on amendments to certain Laws of Ukraine (regarding the strengthening of the criminal liability for the commitment of certain cries) was reported by Petro Symonenko, the People´s Deputy of Ukraine.
Volodymyr Moisyk, the Chairman of the Subcommittee of the Committee on Legislative Support of Law Enforcement announced the decision of the Committee to recommend the Verkhovna Rada of Ukraine the rejection of the indicated Bill. Though, the Verkhovna Rada upheld the Bill.
In the end of the morning meeting, the Parliamentarians scrutinized and upheld the Bill on Amendments to the Clause 37 of the Law "On State Service" and Clause 21 of the Law "On Service in the Local Self-Government Bodies" (regarding the Retirement Insurance).
In the course of the evening sitting, the People´s Deputies continued scrutiny of the agenda issues.
The Bills on Amendment to the Criminal-Procedural Code of Ukraine (regarding the Right of the Witness for the Lawyer) and on Amendments to certain Legislative Acts of Ukraine on Placing in Juvenile Reception Center were adopted as a basis.
The Verkhovna Rada rejected the Bills on amendments to the article 212-4 of the Code of Ukraine on Administrative Infringements and on amendments to the Code of Ukraine on Administrative Infringements and Criminal Code of Ukraine concerning the liability strengthening for the nature protection legislation infringement.
The Bill "On Amendments to certain Legislative Acts of Ukraine on Matters of Military Service, Social Protection of Military Servants, retired Officers and their Family Members" was reported by Serhii Hrynevetskyi, the First Deputy Chairman of the Committee on National Security and Defense. The Bill through the amendments to 18 legislative acts of Ukraine suggests defining of the ensuring the military servicemen with dwelling, provide the single-action dwelling pecuniary damages, allocation of the land plots for the building etc and also restore the participants of the liquidation of consequences of Chornobyl disaster from the quantity of military servicemen previously rejected 10%pension rise, regulate the issue on pensions payment and alter the order of pension rise in connection with the monetary income indexation.
The People´s Deputies upheld the legislative initiative of S. Hrynevetskyi. The Bill was adopted as a basis by 307 votes.
The Parliamentarians scrutinized two more Bills regarding the improvement of the effective legislation in the sphere of security and defence. In the result of the scrutiny ill on Amendments to the Law "On Military Duty and Military Service" was adopted as a basis and the Bill "On Amendments to certain Legislative Acts of Ukraine" (re the Adjusting in Accordance with the Effective Legislation) was adopted as a basis and in its entirety as a Law by 301 votes in favor.
The Verkhovna Rada of Ukraine adopted the Law "On Amendments to the Administrative Legal Procedure Code regarding the Competence of Administrative Courts."
The Bill "On Amendments to the Clause 219 of the Civil Procedural Code of Ukraine" (regarding the Scrutiny Term of the Appeal on Errata and Arithmetic Mistakes Correction in the Juridical Acts) and he Bill "On Amendments to certain Legislative Acts of Ukraine" were adopted as a basis.
In the result of the scrutiny the Parliamentarians rejected Bill on amendments to certain Laws of Ukraine (regarding the bankruptcy of individual person) and the Bill on amendments to certain Laws of Ukraine regarding the implementation of a ten year term of studying fir the compulsory secondary education.
Volodymyr Lytvyn, the Chairman of the Verkhovna Rada of Ukraine adjourned the afternoon meeting.
