PLENARY MEETINGS OF THE FIFTH SESSION OF THE VERKHOVNA RADA OF UKRAINE OF THE SIXTH CONVOCATION WERE HELD ON WEDNESDAY, 16 DECEMBER

 

Mykola Tomenko, the Vice-Chairman of The Verkhovna Rada of Ukraine, presided over the plenary meeting. He briefed on the results of work of The Verkhovna Rada at the plenary meetings on 5 December 2009.

 

The representatives of Deputy Factions presented their announcements, reports and proposals.

 

The Parliamentarians have scrutinized the Bill "On Amendments to the Law of Ukraine "On the State Budget for 2009" regarding the financial stabilization of the coal-mining enterprises

 

The Bill was presented by Mykola Derkach, the Chairman of the Committee on Budget Matters. He declared that the legislative act envisages an extra source of payments effected by the energy-producing companies, fuel-burning power plants, for the coal products of the State coal-mining enterprises to ensure timely payment of wages to the coal-miners. 

 

The People´s Deputies have adopted the Bill in the second reading and in its entirety. In favor voted 376 People´s Deputies.

 

The Verkhovna Rada of Ukraine adopted one more Bill on in its entirety, the Bill "On Amendments to the Law of Ukraine "On the State Budget for 2009" (re Repayment of Debts of the Coal-Mines for the Consumed Electricity)

 

Mykola Derkach, the Chairman of the Committee on Budget Matters briefed that the Bill determines the sources of payment for the current consumption of electricity and repayment of debts for electricity by the coal-mines to be liquidated (coal-mines of the third category).  

 

 The Bill of the Law on ratification of the Convention on the Rights of Persons with Disabilities and its Optional Protocol were briefed by Leonid Savenko, the Vice-Minister on Social Policy and Labour. He declared that ppursuant to the Convention, "States Parties undertake to ensure and promote the full realization of all human rights and fundamental freedoms for all persons with disabilities without discrimination of any kind on the basis of disability".

 

The document states that "in the development and implementation of legislation and policies to implement the present Convention, and in other decision-making processes concerning issues relating to persons with disabilities, States Parties shall closely consult with and actively involve persons with disabilities, including children with disabilities, through their representative organizations."

 

It was also stated that "States Parties to this Convention recognize the equal right of all persons with disabilities to live in the community, with choices equal to others, and shall take effective and appropriate measures to facilitate full enjoyment by persons with disabilities of this right and their full inclusion and participation in the community".

 

The States Parties shall take effective and appropriate measures to eliminate discrimination against persons with disabilities in all matters relating to marriage, family, parenthood and relationships, on an equal basis with others.

 

The Verkhovna Rada ratified the Convention on the Rights of Persons with Disabilities and its Optional Protocol by 390 votes in favor

 

The report of the Temporary Inquiry Panel of The Verkhovna Rada of Ukraine to investigate the Circumstances of Violation of the Constitution of Ukraine and effective Legislation of Ukraine by the Officials, Leaders of the Security Service of Ukraine while fulfilling their Official Duties (re Operation of the NJSC "Naftohaz Ukrainy" and Gas Transport System of Ukraine) was briefed by Roman Zvarych, the Chairman of this Committee. The People´s Deputy informed on the six sittings in the course of which a number of the judicial process was held according to the inquest and investigation order.

 

R. Zvaruch emphasized the fact the Committee there are grounds to have the doubts of the Security Service of Ukraine dignitaries testimony regarding legitimate character of "Alfa" subunit actions in the course of the documents seizure of NJSC "Naftohaz Ukrainy."

 

"The Committee resolution is in following that there are no grounds to speak on certain criminal group consisting of government members it is simple nonsense", - R. Zvarych declared.

 

The Committee Chairman proclaimed that the Committee had not found any evidences of the President of Ukraine interference in this case investigation.

 

The Committee also reached the agreement that the detention of Taras Shepitko, the Vice-Chairman of the energy customs was illegal.

 

As a result of the Temporary Inquiry Panel of The Verkhovna Rada of Ukraine report, the People´s Deputies failed to uphold the Resolution draft and the committee went into liquidation.

 

Parliamentarians have heard the report of one more Committee - Temporary Inquiry Panel of the Verkhovna Rada of Ukraine to investigate the Circumstances of the Poison of the Candidate for the Post of the President of Ukraine, Viktor Andriyovych Yushchenko and finding out the Persons at Guilt

 

Volodymyr Sivkovych, the Chairman of the Committee informed that the criminal legal proceedings have remained nominal since they were resumed.

 

V. Sivkovych resumed that certain high-ranking authorities from the Administration of the President of Ukraine together with the Viktor Yushchenko assistance intentionally falsified the facts of the poison of the Candidate for the Post of the President of Ukraine, Viktor Andriyovych Yushchenko.

 

According to the Chairman of the Committee on the part of certain General Prosecution officers the extensive falsification of the investigation fact was being prepared.

 

As a result of the Temporary Inquiry Panel report scrutiny, neither of the propositions regarding the Panel activity cessation was upheld. The People´s Deputies also failed to pass the Resolution draft elaborated by the Committee members. Thus, the temporary Inquiry Panel continues its investigation till 31 March 2010.

 

Mykola Tomenko, the Vice-Chairman of the Verkhovna Rada of Ukraine announced the meeting adjourned.

 

The next plenary meeting will be held on 17 December.
