The bill (No. 1257) suggests excluding part three form article 277 of the Civil Code, under which, negative information disseminated about a person is deemed to be unreliable, unless a person who spread it has proven the opposite (“presumption of honesty”).   

 

Committee members believe that it is an obligation of a person who spread negative information to prove it.

 

It was stressed that dissemination of negative and unreliable information is considered to be the fact of familiarizing with it of one or several persons.

 

Parliament members believe that importance of “presumption of honesty” lies in reliable protection from negative impact on personal and family life and shifts the necessity to prove negative information on the other side.

 

Committee members noted that part three of article 277 of the Civil Code, which is suggested to be excluded, fully corresponds with part one of article 3 and 297 of the Civil Code.
