The bill (Reg. No. 10668) supplements part 4 of article 93 of the Family Code of Ukraine with a new passage explaining the meaning of the notion “extremely disadvantageous financial condition” used in determination of marriage contract provisions.
The Committee noted that the Fundamental Law of Ukraine (part one of article 51) recognized that both husband and wife have equal rights and obligations in marriage and family.
The Family Code (part one of article 93) stipulated that a marriage contract shall govern the property relations of a married couple, and determine property rights and obligations of husband and wife. Under part four of the abovementioned article, marriage contract cannot put one person in the couple into extremely disadvantageous condition. That is, marriage contract cannot impose obligations only on one person and grant only rights to the other one. Thus, the notion of “extremely disadvantageous condition” is connected with property equality of a married couple.
