The following law was adopted with consideration of proposals by the President of Ukraine

“On economic experiment for creating favorable conditions for development of software industry in Ukraine”

The law determines the procedure of economic experiment aimed at creation of favorable conditions for development of software industry in Ukraine, and increasing production and sales of competitive products in this sphere.

 Under the law, the aim of the economic experiment is: to study the ways of ensuring software industry development in Ukraine; to improve management system in software industry; to establish effective mechanism for cooperation of legal entities and natural persons; to annually increase the number of jobs in software industry at least by 20% from the number of employees working in the sphere in the previous year.

The law was adopted with consideration of all proposals by the President of Ukraine.

The following laws were adopted in entirety:

“To amend clause 9 of section VI of the “Final and Transitional Provisions” of the Law of Ukraine “On depository system of Ukraine” regarding treasury obligations of Ukraine

The Law amends clause 9 of section VI of the “Final and Transitional Provisions” of the Law of Ukraine “On depository system of Ukraine”, as predetermined by part 4 of article 11 of the Law "On Securities and the Stock Market".

The respective bill, with certain specifications, was registered under No.11321.

“To amend the Budget Code of Ukraine” (re formation and implementation of state and local budgets)

The Law aims at settling separate issues connected with formation and implementation of state and local budgets, refine budget funds management, increase financial capability of local budgets, and bring the provisions of the Budget Code of Ukraine in line with other legislative acts of Ukraine.  

 The respective bill was registered under No.11332.

“On amending appendix No. 3 to the Law “On State Budget of Ukraine for 2012” (re reallocation between the budgetary programs of the Ministry of Foreign Affairs)

The Law aims at ensuring implementation of top priority measures regarding operation of the central apparatus of the Ministry of Foreign Affairs, particularly, settling accounts for public utilities and energy, redecoration, etc. 

The respective bill was registered under No.11340.

“On amending appendix No. 3 to the Law “On State Budget of Ukraine for 2012” (re reallocation of expenses of the Ministry of Education, Science Youth and Sports of Ukraine)

The legislative act amends appendix No. 3 to the Law “On State Budget of Ukraine for 2012” in the part of transmitting UAH 380 thousand to the Ministry of Public Health of Ukraine, under the budgetary program "Treatment of citizens of Ukraine abroad" from budgetary allocations to the Ministry of Education, Science Youth and Sports of Ukraine, under the program "Preparation and participation of national teams in the Paralympics and Deaflympics Games".

The respective bill was registered under No.11296.

“To amend article 6 of the Law of Ukraine “On State Budget of Ukraine for 2012” (re financing infrastructural projects)

The Law increases budgetary allocations to the National Agency for preparations and holding of Euro-2012 and implementation of infrastructure projects (hereinafter - Ukryevroinfraproekt) by UAH 35 522.1 thousand.

The abovementioned expenses will be realized at the cost of increased revenues to the general fund of State Budget. Funds will be transferred by the National Bank of Ukraine, according to the Law “On the National Bank of Ukraine” in the sum equal to UAH 35 522,1 thousand.

“To amend article 6 of the Law of Ukraine “On State Budget of Ukraine for 2012” (re financing of combined-cycle power plant construction in Shcholkine town of the Autonomous Republic of Crimea)

The Law was elaborated to create conditions to realize the project of combined-cycle power plant construction in Shcholkine town (the Autonomous Republic of Crimea), as well as develop electricity and gas network supply in the eastern part of Crimea. According to the explanatory note, such project requires USD 1.25 billion.

The Law stipulates amending article 6 of the Law of Ukraine “On State Budget of Ukraine for 2012”.

 The respective bill was registered under No. 11342.

 “To amend article 6 of the Law of Ukraine “On State Budget of Ukraine for 2012” (re financing modernization and reconstruction of gas pipeline network)

The Law was elaborated to realize the Memorandum on mutual understanding between the National Joint Stock Company Naftogaz of Ukraine and "Ferrostaal Industrieanlagen GmbH" of July 2, 2012.

Approximate cost of the project is EUR 50 million, 85 per cent of which will be the loan funds of German Bank "Deutsche Bank”. To receive the abovementioned loan, the Ukrainian Party should support it with state guarantees and insure at the German national export and credit insurance agency "Euler Hermes Deutschland AG (Hermes)".

“To amend the Law of Ukraine “On the State Budget of Ukraine for 2012” (re the purchase of medical vehicles and equipment for healthcare centers)

The legislative act amends articles 1 and 3 of the appendices No.No. 1, 3 and 7 of the Law “On State Budget of Ukraine for 2012” increasing state budget subventions to local budgets for the purchase of medical vehicles and equipment for healthcare centers by UAH 30,900 thousand.

The abovementioned expenses will be realized at the cost of increased revenues to the general fund of State budget. Funds will be transferred by the National Bank of Ukraine, according to the Law “On the National Bank of Ukraine” in the sum equal to UAH 32 875 thousand.

The respective bill was registered under No. 11343.

“On amending appendix No. 3 to the Law “On State Budget of Ukraine for 2012” (re budget allocations of the State Property Agency of Ukraine)

The Law stipulates reallocation of development expenses between the budgetary programs of the State Agency for Administration of Corporate Rights and Property through decreasing them by UAH 258,9 million, according to the Budget program “State support of production of aircraft, helicopters and engines to them through the mechanism of credit reduction”, to:

new budgetary program "Replenishing ownership capital of Kharkiv State Aircraft Manufacturing Company and State Enterprise “Antonov" in the amount equal to UAH 243.1 million;

new budgetary program "State support of domestic engineering for agriculture, through the mechanism of credit reduction (for repayment of debt, which arose in 2009)" in the amount equal to UAH 7.6 million;

increase expenses for implementation of measures to restructure and liquidate objects of mining Chemistry (program code 2601090) by UAH 8,2 million.

Thus, the general amount of sate budget expenses remains unchanged.

“On amending appendix No. 3 to the Law “On State Budget of Ukraine for 2012” (re reallocation of expenses to the State Agency of Land Resources of Ukraine)

The Law stipulates reallocation of Sate Budget expenses through decreasing development expenses by UAH 785 thousand and increasing by the same amount consumption expenses (for labour remuneration), according to the Budget program “Issuing state acts of private ownership rights to land in rural areas”. Thus, the general amount of sate budget expenses remains unchanged.

“To amend the Law of Ukraine “On State Budget of Ukraine for 2012” regarding increasing expenses for technical reequipment and labour safety on coal mining enterprises”

The Law aims at ensuring technical reequipment of coal mining enterprises and increasing coal output, as well as the safety level of pitchwork.

The legislative act stipulates increasing expenses of general State Budget Fund to the Ministry of Energy and Coal Industry by UAH 1 510 million.

The respective bill was registered under No. 11328.

“To Adopt the Amendments to the Articles of Agreement of the International Monetary Fund”

The Law stipulated adoption of Amendment to the Articles of Agreement of the International Monetary Fund regarding reconsideration of member-state quotas and reformation of the administrative system of the International Monetary Fund approved by the Board of Governors Resolution No. 66-2 of December 15, 2010. In particular, relative quota for Ukraine in the International Monetary Fund shall increase by 639.8 million to 2011.8 million of special drawing rights.

“To amend several legislative acts of Ukraine (re optimization of powers of executive authorities in the sphere of environmental policy and use of natural resources, including those on the local level)”

The law harmonizes a number of legislative acts of Ukraine in the spheres of environmental protection; rational use, reproduction, and protection of natural resources (mineral resources, water, atmosphere, forests, flora, and fauna); organization, protection, and use of nature-reserve fund; treatment of waste, pesticides, and agrochemicals; formation, preservation, and use of the environmental network with the Constitution of Ukraine in part of redistribution of powers between the President of Ukraine and the Cabinet of Ministers in connection with the administrative reform.

The respective bill was registered under No. 10218.

“To amend several legislative acts of Ukraine (re activity of the Ministry of Science and Education, Youth and Sports of Ukraine, Ministry of Public Health, Ministry of Energy and Mining and other central executive bodies guided and coordinated by the respective ministers, and the State Committee for Television and Radio Broadcasting)”

The Law brings legislative acts of Ukraine pertaining to the sphere of  public health, sanitary and epidemiological welfare, creation, production and control over the quality and realization of medicines, immunobiological medications and medical goods, combating HIV-infection/AIDS, as well as other socially dangerous diseases, science and education, innovation and informatization, intellectual property, youth, physical training and sports, television and radio broadcasting, legislative acts pertaining to informational and publishing spheres, safe use of nuclear power, electricity, nuclear, coal, peat mining, as well as oil and gas sector, into conformance with the Constitution of Ukraine in the part of redistribution of powers between the President of Ukraine and the Cabinet of Ministers of Ukraine in connection with the administrative reform, the Laws of Ukraine "On the Cabinet of Ministers of Ukraine", "On Central Executive Bodies", and the Decree of the President of Ukraine "On optimization of the system of central executive bodies."

The Law was adopted in the version of the first reading.

“To amend several legislative acts of Ukraine (re activity of the Ministry of Agrarian Policy and Food, Ministry of Social Policy and other central executive bodies guided and coordinated by the respective ministers)”

The Law brings legislative acts of Ukraine on state agrarian policy, food safety, fish industry, living water resources, navigation safety for fishing fleet, veterinary medicine, quarantine and plants protection, protection of rights to varieties of plants, land relations, forestry and hunting farms, employment and labor migration, labor relations, social protection of people, family and children?s issues, as well as on protection of rights of the persons deported due to nationality, who returned to Ukraine, into conformance with the Constitution of Ukraine in the part of redistribution of powers between the President of Ukraine and the Cabinet of Ministers of Ukraine in connection with the administrative reform, the Laws of Ukraine "On the Cabinet of Ministers of Ukraine", "On Central Executive Bodies", and the Decree of the President of Ukraine as of December 9, 2010 No. 1085 "On optimization of the system of central executive bodies."

 The Law was adopted in the version of the first reading.

 “To amend several legislative acts of Ukraine (re activity of the Ministry of Justice, Ministry of Culture and other central executive bodies guided and coordinated by the respective ministers, as well as of the State Space Agency)”

The law brings the legislative acts of Ukraine governing social relations in the sphere of archive-keeping, record-keeping, establishment and functioning of the state system of insurance documentation fund, execution of criminal sentences, protection of personal data, state registration of legal entities and sole proprietors, culture and arts, cultural heritage preservation, export, import and return of cultural valuables, cinematography, international relations, religion and protection of rights of national minorities in Ukraine, and space activities into conformance with the Constitution of Ukraine in the part of redistribution of powers between the President of Ukraine and the Cabinet of Ministers of Ukraine in connection with the administrative reform, the Laws of Ukraine "On the Cabinet of Ministers of Ukraine", "To Amend the Law of Ukraine ‘On the Cabinet of Ministers of Ukraine?", "On Central Executive Bodies", and the Decree of the President of Ukraine as of December 9, 2010 No. 1085 "On optimization of the system of central executive bodies" (clauses 1 and 2).

 The law was adopted in the first reading version.

 The respective bill was registered under No. 10221.

 “To amend several legislative acts of Ukraine (re activity of the Ministry of Internal Affairs, the Ministry of Emergencies, the Ministry of Regional Development, Construction, and Housing and Public Utility Sector, and other central executive authorities whose activity is directed and coordinated by the respective ministers)”

The primary purpose of the law is to harmonize the legislative acts of Ukraine with the Constitution of Ukraine, the laws "On the Cabinet of Ministers of Ukraine" and "On the central executive authorities", and other legislative acts in part of redistribution of powers between the President of Ukraine and the Cabinet of Ministers in view of the administrative reform.

“To amend several legislative acts of Ukraine regarding determination of the Parties of collective negotiations”

The law stipulates establishing the levels of collective negotiations and the Parties by which the negotiations are conducted.

The law allows for bringing the provisions of several laws in line with the unified in modern normative acts definition of the notion of "employer" and substituting the notion of "owner" by the notion of "employer".

The Laws "On Collective Agreements", "On the Cabinet of Ministers" and several Laws on social insurance are amended.

The respective bill was registered under No.10106.

“To amend several legislative acts of Ukraine regarding legacy registration”

The law amends the Civil Code of Ukraine and the Law “On Notary” to entitle officials of village and township councils, as well as other bodies of local self-government execute notarial actions regarding legacy in places where there are no notaries.

The respective bill was registered under No.11047.

 “To amend article 8 of the Law "On Collection and Register of Single Contributions to Mandatory State Social Insurance" (re payment of single contribution)

The Law cancels distribution of the single social contribution according to the types of mandatory state social insurance depending on the classes of professional risk of different productions with consideration of their economic activity; it also reconsiders the rate of deductions from the basis for budgetary institutions, companies and enterprises employing disabled persons, for salaried employees, military men, public officials, etc.

Under the bill, calculation of distribution of the single contribution according to the types of mandatory state social insurance shall be held on the basis of accounts for the results of the previous year.

“To amend several legislative acts of Ukraine (re restrictions for the use of assisted reproductive technologies)"

Under the law, the married couple can not be declared parents of a child, if one of the spouses is a citizen of the foreign state where the use of assisted reproductive technologies is prohibited. An adult woman who undergoes artificial insemination and embryo implantation shall not be more than 49 years of age on the date of implantation. In exceptional circumstances the age limit for a woman might be raised on the grounds of the expert conclusion given by the central executive body on healthcare.

“To amend several legislative acts of Ukraine in connection with adoption of the Law "On the Status of Foreigners and Stateless Persons"

The law contains the definitions of a number of documents including permanent residence permit, long-term visa, passport, etc.

In addition, the document determines that court claims by foreigners and stateless persons to appeal against their forced return to the country of origin or a third country, or court claims by the central executive body realizing state policy on migration, bodies of border control or the Security Service of Ukraine concerning forced deportation of foreigners or stateless persons outside the borders of Ukraine shall be submitted to  the administrative court at location of the central executive body realizing state policy on migration, border control body or the Security Service of Ukraine or at location of the temporary stay facility of foreigners or stateless persons who stay in Ukraine illegally.

“To adopt the National Target Program to Fight Tuberculosis for 2012 – 2016”

The Law has been elaborated to improve epidemic situation to decrease the total number of patients with tuberculosis, decrease incidence and death rate from tuberculosis and co-infection TB/HIV, diminish the spread rate of multi-resistant tuberculosis, as well as ensure general and equal access of population to quality services of tuberculosis prevention, diagnostics and treatment.

The document stipulates a number of measures.

Financial provision of the Program shall remain within expenses allocated in the state budget to the main funds administrators responsible for realization of the Program, as well as at the cost of local budgets and the grant from the Global Fund, and other sources. Total amount of Program financing for 2012-2016 comprises UAH 1 billion 830 million 800 thousand, including state budget funds – UAH 1 billion 236.5 million, Global Fund funds – UAH 592.3 million, and other sources – UAH 2 million.
