Particularly, the Committee declared that the bill to adopt the National Target Program to Fight Tuberculosis for 2012 – 2016 (Reg. No. 11046) developed to implement the Law “On Fighting Tuberculosis” and due to completion of National Program to Fight Tuberculosis for 2007 – 2011 does not contradict the European law and international and legal obligations of Ukraine.
The Committee noted that by the subject of legal regulation the bill pertains to the sphere of health and life protection of people, animals and plants and is regulated in the EU by the following documents: the Treaty establishing the European Community (consolidated version), the Charter of Fundamental Rights of the European Union, the Decision No 2119/98/EC of the European Parliament and of the Council setting up a network for the epidemiological surveillance and control of communicable diseases in the Community, and Regulation (EC) No 1568/2003 of the European Parliament and of the Council on aid to fight poverty diseases (HIV/AIDS, tuberculosis and malaria) in developing countries.
The Committee members concluded that the amendments suggested do not contradict the law of the European Union.
The Committee noted also that the bill to amend article 8 of the Law “On Advertising” regarding prohibition to indicate the price of goods, works and services in other currencies than the Ukrainian one (Reg. No. 11121) does not contradict the European law and international and legal obligations of Ukraine. The bill determines that the information about prices to goods, and tariffs for services indicated in advertisements distributed or placed on the territory of Ukraine should be indicated in Hryvnia only.
The committee members noted that by the subject of legal regulation the bill pertains to the sphere of consumer rights protection, legal relations of which are governed in the EU by the Treaty establishing the European Community (consolidated version).
The Committee members concluded that the amendments suggested do not contradict the law of the European Union.
Particularly, the Committee stressed that consumer rights protection and improvement of their welfare is one of the main values of the EU. The provision regarding the joint policy of the EU member states regarding consumer rights protection is defined in the article 153 of the Treaty establishing the European Community. The main aim of which is to ensure high level of consumer rights protection.
