The bill (Reg.No.10365) suggests improving and streamlining the procedure of state registration of land plots and property rights in real estate as well as their encumbrances by amending the Laws "On Notary", "On state registration of rights to real property and encumbrances" and several other legislative acts.
It is stipulated to supplement article 4 of the Decree of the Cabinet of Ministers "On State Duty" with the provision according to which: 49) bodies of state authority (officials) have privileges for the payment of state duty - for state registration of rights to real property and encumbrances; 50) bodies of executive authority and bodies of local self-government for state registration of the right of state or territorial community to land plots as based on the law; both have privileges to pay the state duty.
The Law "On Notary" is supplemented by article 461 on notaries? authority in the sphere of state registration of property rights in real estate and encumbrances.
The Law "On state registration of rights to real property and encumbrances" stipulates that state registration of the property rights the registration of which was done in compliance with the laws that were in force at the time of their occurrence, as well as conduction of a notary act of real estate - construction in progress is conducted by notary performing such act. State registration of rights as a result of a notary act of real estate - construction in progress is conducted by notary performing such act.
The bill stipulates the possibility to file a document for state registration of rights both in paper and electronic form through implementation of the mechanism of submission of these documents by state cadastral registrar.
The bill also regulates interaction between the bodies in charge of state registration of rights and the bodies of the state executive service, etc.
During the preparation of the bill for the second reading 50 proposals from the subjects of legislative initiative were received; the majority of them were taken into account.
