It was mentioned that the bill (Reg.No.10445) suggests excluding article 10-1 out of the abovementioned Law. The Head of the Kyiv City State Administration is appointed by the President of Ukraine in the order prescribed by the Constitution and Laws of Ukraine. Thus, renewing the overlapping of the positions of the Kyiv Mayor and the Head of the Kyiv City State Administration.
The appointment of the Head of Kyiv City State Administration by the President of Ukraine is stipulated by the Constitution of Ukraine (part four of the article 118). According to part two of the Fundamental Law the person elected by the territorial community as Kyiv Mayor has to lead the executive body of the City Council.
The Constitutional Court declared that the Kyiv City State Administration should be governed only by the person elected by Kyiv Mayor who is in accordance with paragraph four of the article 118 of the Constitution of Ukraine is appointed by the President of Ukraine as the Head of Kyiv City State Administration.
